Dies Martis. Novr the 8t 1698.

The house mett againe and were called over, Capt Tho:
Waughop, Mr Philip Clarke, Capt Philip Hoskins, Mr Benja
Hall, Mr Geo: Ashman, Mr Iohn Ferry and Mr Wm Hemsley
being absent. Mr William Hemsley enters the house.
Read Mrs Lewellins peticon for 18000lb of Tobo due for her
husbands Sallery as clk: of the Councill.
Referred to the Comittee of accs to be allowed if not already
paid.
Read Mr Feilders peticon for allowance for making the
modell of the Church and drawing Severall draughts of the
Same.
Referred to the Comittee of accounts to allow him 5ls Sterl:
The honble Thomas Brookes Esq. and Iames Frisby Esq.
enter the house and informe Mr Speaker that his Excy Comands
him and the whole house to attend him and the Councill Im-
ediately.
Mr Bladen Clk: of his Majties honble Councill enters the house
and informs the Clk: of this house that his Excy in his Majties
name comands him to bring the Iournall last night Sealed up
before his Excy and Councill.
Mr Speaker and the house go to the Councill Chamber
Att the Councill Chamber the house was called over, and
the persons aforenamed were absent.
His Excy was pleased to order the clk: of the Councill to
read the address of this house on behalfe of Mr Robert Mason,
upon which his Excy was pleased to remarke.
1. The cause of his suspending Mr Robert Mason from
Executing the office of Treasr was that because he was found
Guilty by the Grand Jury of this province of a notorious Crime
and for which he was indicted and by his own Confession
acknowledged himselfe Guilty. Wherefore he thinks that he
has in no wayes infringed the Laws of this province for that
upon such occasions the power was Invested him when the
officers had by any means Incapacitated themselves for to
appoint others.
2. That as he governs this Country by Comission from his
most sacred Majty King William the third to whose Laws we
all pay reverence and obedience, that in obedience to an order
he recd from their Excys The Lords of the Councill for Trade

and plantations he had sent to the said Mason to Comand him
to send his acco which he had refused to do for a considerable
time and when he did send his acco that he had over charged
the Country 50l Sterl:
3. That no money had been demanded of him nor appro-
priated to any other use then what had been allowed of by the
