Mr Speaker informs the house that hed recd a message from
his Excy since the house adjourned that the house should
attend upon his Excy Instantly.
Mr Speaker and the house go downe to the Councill
Chamber.
Att the Councill Chamber, the house was called over and
were absent Capt Thomas Waughop, Mr Wm Taylard, Mr
Philip Clarke, Major Iohn Lowe, Mr Thomas Beale, Mr George
Ashman, Mr Wm Hemsley, Mr Ffrancis Ienkins, Mr Iohn Boz-
man, Mr Walter Lane, and Mr Samll Collins.
His Excy was pleased to order the address sent on behalfe
of Mr Philip Clarke to be read, which accordingly was done.
Whereupon his Excy Informs them that he would make
distinctions amongst them and se who were for the King and
who were against him for that Mr Philip Clarke is held in
prison for being Guilty of the breach of the Act of Assembly
of this province agt Divulgers of falce news for the breach of
which he hath been found guilty, as well as by the oaths of
the Grand Jury for the body of this province as by the Oaths
of the Petit Iury upon his tryall, and the Oaths of other evi-
dences.
His Excy was pleased to order the afd act of Assembly agt
Divulgers of falce news together with Mr Bladen deposicon to
be read.
Which accordingly was done.
Whereupon his Excy was pleased to inform the house that
he is Imprisoned for six months by the virtue of that act and
that whosoever shall Endeavour to take him out of the Kings
prison he must declare him or them to be a Rebell or Rebells.
And his Excy further Remarked that he admired how they
could say the prayer in the Litany agt Sedicion, and act as he
apprehended it, so seditiously.
