Marine Committee Nov. 13 1778

The Navy Board of the Middle District laid before the com-
mittee the proceedings of a Court of Inquiry held relative to
the loss of the Continental Sloop Hornet, John Nicholson
Esquire Commander, Wherein the Court are of opinion that
the loss of the Hornet was not occasioned by any neglect or
want of spirit in Capt Nicholson but in consequence of his
being attacked by a force greatly superior to his own.
The Committee having read and duly considered the pro-
ceedings of the Said Court concur in Opinion that the loss of
the Hornet was occasioned by her being attacked by a super-
ior force, and that Captain Nicholson behaved as a spirited
good officer.

Ordered that the Commissary of Stores deliver to Serj
Lamb 1 Coatee 1 pr Overalls, & 1 pr Shoes for a recruit named
James Flint, enlisted by Ensign Burgess to be charged to the
1 Regt & 1 Coatee & 1 pr Overalls for himself
That the western shore Treasurer pay to Capt Beriah May-
bury One hundred and Eleven Pound, Seventeen shillings &
six pence due him per Acct passed by the Depy Aud. and also
the further Sum of One hundred Pounds on Account.

In Council Annapolis 30th June 1779
Sir
The Bearer Mr Robert Swails, thinks it is in his Power to
recruit Men in St Mary's County and for that Purpose solicits
a Warrant from this Board. He brought a Letter from Colo
Plater, but not a sufficient Recommendation to justify an
Appointment. The Colo writes, he is not acquainted with
his Character, he is equally a Stranger to us and as we are
informed, well acquainted with you. We beg your Opinion
of his Prospect and the Propriety of appointing him
