D. and their living so remote, except his honr Coll: Greenberry Whitehall who is much indisposed and very lame of the gout, therefore more of his Mats honrble Councill could not possibly in any reasonable time be got together) setting forth that his sd Ship had been lately seized by Mr Thos Collyer through the information of one Gabriell Parrot for importing Goods con trary to the Act of Parliamt & being an unfree bottom &ca therefore humbly prayed a Speciall Commission might issue for Tryall of the sd supposed breaches whereby a Speedy end might be put thereto, as by the sd Petition recourse being thereunto had may more at large Appear His Exncy (by Ad vice) was p!eased to Ordr thereon as it is hereby Ordered that the sd petition be Referred to Mr Attorney & Sollicitor Gen” and Mr Robert Gouldesborough his Mats Councill at Law for them Severally to make a Speedy Report thereon whether such a Commission may legally issue; And it is hereby further Considered and Ordered tht if in Case they or any two of them are of Opinion that such Commission may legally be Granted, That then a Commission do accordingly issue forth of the honrble the Secretary's Office, according to Usuall Custom & fform, hereby Constituting & appointing Majr John Hafflond, Capt Richard Hill, Capt Thomas Tasker, Mr Philip Hoskins, Mr Thomas Staley & Mr Willm Hatton or any three of them to be Commissionrs & Justices for the sd End and purpose to hear and determine the sd Matter, provided one of the two ffirst mentiond be alwaies prsent And that Mr Attorney & Sollicitor Genll do ascertain the time, for the Speedy bringing her to Tryall so that the sd Commissionrs may meet & sit at the Port of Annapolis for the sd End and purpose some time this month, which his Exncy is in hopes may be Effected by the 20th instant if bad wether or some other unavoidable Accident hinder not, it being deemed that the same will Conduce most to his Mats Service & benefit of the parties concern'd; And for the more quick Expedition of the matter it is hereby further Ordered that they or either of them insert the time of the Justices meeting to Sit in the blanck Summons for that End & purpose issued by Ordr forth of the (honrble the Secre tary's Office herewith sent and that they take Care to dispatch the same away according as they are Severally directed to the End the sd Justices may have due & Speedy Notice given them; And lastly the sd Mr Attorney and Sollicitor Genll are hereby Expressly Ordered to make ready and due comply ance herein & give their timely attendance here in Ordr to prosecuting on his Mats behalfe & preparing all things ready for the sd Tryall. His Exncy is pleased to demand of Mr Carroll, who was sent for, being of Councill for the Petr whether he could advise of
