To the Rt Honble the Lords of the Committee of Trade & Plantations.
In obedience to yor Lordships Ordr of Reference of the 19th of September last I have considered of the severall Demands made by my Lord Baltemore in the Province of Maryland and Represented to their Mats by the Assembly of that Province, and I have been attended by the Lord Baltemore and his Councill; and as to his Lops first Demand of Twelve pence p Hogshead for all Tobacco exported out of that Province, I finde the said Duty is part of a certain Duty of two shillings a Hogshead for all Tobacco exported from that Province, Granted by an act of the Assembly there, of the 7th of March 1671, One Moiety whereof is by the said Act appropriated to the publick service for the better Support of the Government; and the other Moiety (which is the Twelve pence a Hogshead now demanded by the Lord Baltemore) is thereby granted to the Lord Baltemore, to be received by him for his owne Use as Proprietor of the said Province and that the said Twelve p. zz pence a Hogshead was by Ordr of Councill, the 26th of ffebry 1690, directed to be answered & paid to the Lord Baltemore, as Proprietor of Maryland, and I doe not finde, that the As sembly doe much contest my Lords Right to this Duty of Twelve pence a Hogshead, in the Representation they have made to their Matys where they say they are with their Mats Royal Assent ready to confirme the same to his Lop provided his Lop Grant the same Conditions of Plantations, he did be fore the happy Revolutions; or the same, that their Majties doe to the Colony of Virginia, to the Inhabitants of that Province; But what those Conditions are, it doth not appeare to me, otherwise than by looking into the said Act of Assembly in 1671, by which the said Duty was Granted to the Lord Balte more, Upon condition, that his Lop should accept a pound of Tobacco instead & lieu of every Two pence Rent at any time reserved vpon any Grant of Land made by his Lop which Condition his Lop affirms to me, he alwaies hath and still is ready to comply with. As to the second Demand of ifourteen pence p Ton for all Tobacco's exported out of that Province, I finde by an Act of the Assembly of that Province in 1661, it was Enacted, that all Vessells whatsoever not properly belonging to that Pro vince haveing a Deck flush fore & aft, comeing in, and Trade ing within that Province, should pay for Port Duty's & Anchor age a pound of powder, and Three pounds of shot, or soe
