declares he knowes nothing, neither was he at the house of
the said Tovey the day on which he dyed; but some day in
November last (but the certain day cannot remember) saith he
was at the house late of Samuel Tovey deed: and that Major
James Ringold came to the said house, and demanded of the
then widow Mrs Anne Tovey a Mortgage which he said did
belong to him from her deed: husband, the said Anne replyed
she did not know of any such paper, if it were there it did not
belong to him, neither was she then in a capacity to deliver
any papers; after a little time the said Ann did ask my advice,
whither she might deliver any papers, I replyed I would not
advise any way, but after some short time she tooke out two
or three bundles of papers, and threw them on the Table, and
the said Mortgage was in one of the bundles, and delivered to
Major Ringold, but by whom this Deponent is not certain, but
to the best of his knowledge it was delivered by Jonas Greene-
wood then p'sent. The said Mortgage was delivered to Jonas
Greenewood. and by him read and delivered to Major Ringold

again, and by him carried away, This Depont saith that Mrs
Tovey then required a coppy of the said Mortgage, Majr
Ringold replyed (to the best of the Deponents knowledge) he
knew noe occasion to give her a coppy of it, neither was there
any coppy then given, nor any threatning or abusive speeches
by said Ringold to the said Anne Tovey, and further saith not
Tho: Smyth

Jonas Greenewood's Depos:

Jonas Greenewood aged 34 yeares being duely sworne and
examined at the request of Anne Joce saith

That he was at the house of Mr Samuel the day on which
he dyed, and haveing watched with the said Tovey two or
three nights before his death, that on that day he dyed, he
went to sleep, and did not see any thing of what was done
that day, but after the Deponent awaked he did heare it
reported that Majr Ringold with some other persons was at
the breakeing open some chests to search for a will and (as
the Deponent heard) it was upon the accot of Mr Toveys Chil-
dren in England: as to the Demanding a Mortgage by Major
Ringold of Mrs Tovey, This Deponent Saith he was at the
house of the said Tovey on or about the 14th of November
last, and Major Ringold comeing to the house the same time
did demand a Mortgage of Mrs Tovey, to which sd Tovey
replyed she would not deliver any papers to any One, neither
was she in a capacity to doe it, to which Major Ringold said, if
shee did not deliver it, he would take some speedy course to
