in the third yeare of his Lopps dominion in the yeare of o^r
Lord 1678 Entituled An Act for regulateing Ordinaries & lim-
iting the numb^r of them wthin this province yet Notwithstand-
ing the good provision thereby made against such exaction
Experience of late hath found the same soe farr from remedy-
ing the said Abuse th^t many of them are growne more
excessiue & outragious in their prices & to avoyd the penalty
of the said Law doe refuse to deliuer when desired vnto their
debtor vnder their hands the pticulars of the Liquors &
accomodacons had & receiued of them feareing the same
should discouer their vnjust charge against the said Act &
often times when the said debtors are overtaken in drink
fraudulently obtaine bills vnder their hands & scales for such
their debts vnjustly charged whereby their books are dis-
charged w^ch otherwise in sueing the said accompt the said
books in Court would discouer their illegall exaction by w^ch
cunning devises they often avoyd the penalty of the said Law
& much damnific the said debto^rs to prevent w^ch abuses for the
future Be it enacted by the right Hono^rable the Lord Prop^ry by &
with the advice & consent of the vpper & lower houses of this
p^rsent genii Assembly & the Authority of the same th^t from
& after the twentieth day of Aprill in the Yeare of o^r Lord
1689 noe Ordinary keeper whoever w^thin this province for any
debt due to him for Liquor or any other Ordinary accomo-
dacons shall take any bill bond or other security other then the
acc^o charged in his booke for the same or recouer Judgm^t in

any court of record wthin this Province for such debt till he
hath before one Justice of the provincall or County Court or
one Alderman of the Citty of S^tt Maries first taken his cor-
porall Oath th^t the pticulars of the said Acc^o are truely rated
according to the rates & prices sett & Assessed by the Justices
Impowred thereto by the aforemenconed Act of Assembly &
th^t the same was sold & deliuered by order of the said debt^r
to the said debtor or his appoyntm^t & th^t bona fide wthout
fraud he bought the same Liquors for quallity as in his said
Accompt he hath named them, & sold the same againe wthout
any mixture or Imbasem^t other then what was ordered by the
said debtor or w^th his consent w^ch Oath soe taken shall be cer-
tified vnder the hand of such Justice of the Provin^ll or County
Court or Alderman of the Citty of S^t Maries before whome
the same shall be taken & deliuered to the said debtor before
any security be taken otherwise the said bills bonds & all
other security shall be voyd & a perpetuall barr against the
said creditt or other then the said booke debt legally charged
according to Act of Assembly as aforesaid for w^ch said certifi-
cate they shall pay to the Clarke the said Justice shall imploy
