to them shall seeme meete to be Comission^rs togeather w^th the
other Comission^rs to Execute this p^rsent Act w^ch said Comis-
sion^rs soe by them appointed not exceeding the number of fiue
shall haue the same power & authority Equall w^th such other
Comission^rs nominated in the said first recited Act to all intents
& purposes whoever provided th^t after the said first day of
August 1688. nothing in this Act shall be construed, That
pipe staues timber or other such like lumber shall be housed
in the Towne houses or store houses as Tobaccoes & other

goods & Merchantdizes before menconed are to be but onely
to be vnladen & landed & Certificate therefore giuen as afore-
said And further be it Enacted th^t all Lotts th^t shall not be
taken vp in any towne place or port either in this or the other
two former Acts named before the end of fiue yeares from the
comencem^t of the first recited Act shall revert to the first
owner or owners of the said land to be in the same Estate as
he or they were seised or possessed of at the time the same
was sould but notwithstanding shall be deemed & reputed as
Towne lands & haue hold & Enjoy the same liberties privi-
lidges & imunities as any other letts th^t haue or shall be built
vpon provided Nevertheless th^t such owner or owners of such
vntaken vp lotts at any time within fiue yeares after the expi-
racon of the said last menconed fiue yeares vpon tender of
any pson or psons of double the value of the first purchase of
a Lott in such Towne & of the charges of first takeing vp the
same shall not refuse but shall accept the same in full satis-
facon of such lott &. th^t such owner or owners shall iherevpon
at the costs & charges of such taker vp make good & suf-
fitient assureance to such taker vp & his heires & vpon
refusall of the same the pson tendering the same & his Heires
shall be from thenceforth invested settled & seized of & in
the same lott in as ample manner as if he had taken the same
vp in due & lawfull time & likewise if any impediment shall
be in such owner or owners th^t they cannott make legall
assureance by reason of Coverture non sane memoriae non
age or otherwise th^t then such taker vp shall be settled seized
& invested in the said lott or lotts to him & his heires as if
duely takeing vp as aforesaid paying to the said owner or
owners double as before is menconed such takers vp still fol-
lowing the directions in building or otherwise of this & the
two former Acts herein before recited And be it by the
Authority aforesaid Enacted th^t the seuerall Townes hereafter
named & by the said former Acts made places & Townes for
trade but now being found by Experience to be places noe
wayes fitting or convenient for the same Viz^t th^t Towne on
Morgans Land formerly called Barrows towards the head of
