[Kell's Protest.]

Northampton County Virginia March 20th 1776.
Personally appeared before me one of his Majesties Justices
of sd County Thomas Kell master of the Schooner Dolphin of
and from Baltimore Robert Bailey mate & William Cunning-
ham seeman and made oath on the holy Evangely of Almighty
God, that on the 12th day of February 1776, they sailed from
Baltimore bound for the Island of Martinico, and on the 26th
ult being betwixt the horse shoe, and Cape Henry was chased
by two of the Kings Row boats & one tender, which caused
them to bear away & run into Cheristone for the Safety of
Vessel & cargo, & there waited for a favourable opportunity
to run to sea, & farther these deponents declares that on the
4th of March a sloope tender attempted to come in to said har-
bour in order to take them out but was prevented by running
aground, & farther declare that on the 18th Instant a sloop
tender came in & took possession of said Schooner Dolphin,
hove up her anchor and made sale in order to run her out &
at the esterne of the harbour they run aground, after which
said Tender plundered & took from said Dolphen salt & fresh
provisions togeather with cordage cabbin furniture &c, and on
the 19th the said Tender made another attempt to carry out
the Schooner Dolphin but was repulsed & prevented by two
companies of minute men, one Company of Regulars, & several
of the Militia, and finding that said Schooner Dolphin could
not get out with safety and consulting the Committee in the
County of Northampton, which their advise was to land the sd
cargo & then for the sd Captn to proceed up to the owners for
further orders from Council of Safety and the Deponents pro-
tests against the said Tenders & Row boats for their detention,
Damages &c. which they and their owners have or may sustain
from the said Tenders & Row boats

Gentlemen. Calvert County March 20th 1776.
In obediance of the appointment from your Honourable
Board (as a collector of hard Cash) have collected about £200
which is now in my possession and only wait for a safe oppor-
tunity to convey it to you. I have given this day an order on
the Treasurer of the Western Shore to pay Col. Fitzhugh
£24...14.. 2 Curry for the gold and silver I had of him. If you
point out the way of conveyance it will be strictly by Gentlemen,
