or Owners or any psons Interested In the s^d Lands whether
within or without this Province even agst his Lord^spp the R^tt
Hono^ble the Lord Prop^ry of this Province his Heires & Suc-
cessors saveing the Rents hereby in this act to his Lord^spp his
Heires & successors Reserved, & likewise upon tender of
paym^t & refusall the s^d Building as afores^d with proofe of the
tender & refusall, shall be binding to all intents & purposes
ags^t the sd p^tys and theire Heires & Assignes so as afores^d
refuseing or others Claiming any title or Interest in the sd
Lands & grounds & shall be a full authority for the said Com^rs
to Cavse the same to be Converted to the uses & purposes
afores^d & th^t the Com^rs of each Respective Covnty in this act
named appoint a pson to keep a booke to enter downe each
mans Choise of any Respective Lott, th^t he shall Choose, that
hereby it may appeare what Lotts are taken up, & what
remaine undisposed of, & in Case any difference happen to
arise in or about takeingup the sd Lotts or the pticular
Divedents, hereby allotted or any other matter referring to the

Execucon of this Act the sd Com^rs in each Respective Covnty
or any five of them shall Imediately without any formality of
Lawe Or terms heare & determine such difference according to
their discretions,
And be it Enacted by the authority afores^d th^t the surv^r
shall have and Receive for surveying each Respective Lott
being marcked & staked out as afores^d the sume of thirty
pounds of tobbacco p Lott to be pd by him or them th^t shall
take up the sd Lott or Lotts.
And in Case the taker up of the sd Lott or Lotts refuse or
neglect to build by the time appointed in this act that then it
shall be Lawfull for any pson or psons whatsoever to enter
upon the sd Lott or Lotts paying such sume of Tobbacco as
shall be first sett upon such Lott to the Com^rs afores^d of such
Respective Covnty or such pson who they shall appoint for
the publick use & benifitt of such Towne pvided the second
taker up or purchaser begin to build within one month after
such his entry, made such house as in this act is Limitted and
appointed, & shall finish the same within six months next after
such entry, made as afores^d which hovse so built shall give &
settle an Estate of Inheritance to him & his Heires for ever in
the pson so building as afores^d upon the s^d Lott or Lotts as
afores^d & in Case any the s^d Lotts shall be neglected to be
taken up for & dureing the terme of five yeares aft^r the
pclaiming of this act, th^t then & in such Case, the Owners &
Persons Interested shall be possesst of the s^d Lott or Lotts as
in theire first & former Estate, any thing in this act Contained
to the Contrary in any wise notwithstanding. Be it further
