Tho: Speake Gentn pr Attornat Edw: Packer made his ap- Liber A. pearance att this Court, & desyreth to haue the cause heard & determined wch is commenced agst by Mr Tho: Copley. The sd Mr Copley not being in the pro: & noe Attorney for him prnt in Court to make demand, or proue. The cause is Respited till next Court wth the consent of the abouesd Mr Speaks At torney.
Att a Court held att John Neuell att the request of ffrancis Van St Johns 10o ffeb. Enden sayth uppon his oath, That before Prnt Gouernor Christmas last att Tho: Peteet's howse Mr
Jno Hallowes bargayned wth ffrancis Van Enden & couenanted tht the sd ffrancis should make our all his right in his Leuy this yeare unto the sd Hallowes, in consideraon of a debt wch the sd Hallowes claymed of him. Whereuppon the sd Hallowes ingaged himselfe, tht after bee should receaue the sd Leuy, to trust the sd ffrancis wth 1000 l Tob. in goods. the sd ffrancis gyuing Bill for the paymt thereof againe the next yeare & further he sayth not. Jno + Neuell Jurat in caria.
Vppon the demand abouesd of Tho: Hebden plf, uers Tho: Jackson deft, the deft being called, & not appearing by him selfe, or Attorney (this being the last day of the Court) The plf produced the Bill of the sd Tho: Jackson in Court for 350' Tob. & cask. & declared uppon oath tht he neur receaued any satis faction therfore. Whereuppon it is Ordered .by the Court tht the plf should recour according to his demand.
Vppon the demand of Nicolas Gwyther plf, uers Tho: Jack son deft The deft not appearing as abouesd the plf was admitted to proue his demand. & the demand appearing uppon Record, tht the demand was according to a iudgmt of Court 6o De cembris. ut Supra. It is Ordered tht the plf shall recour 265 l Tob & cask wth is fownd due, in Mrs Margarett Brents hands, uppon the acct of his L
Vppon the complt of Mrs Margarett Brent plf uers Edwards Comm ins deft. The deft pr Attornat George Manners desyreth respite till next Court, for tht he hath not his euidence ready in Court, whereby to proue, tht the deft hath satisfyed Capt Giles Brent, for what could bee alleaged concerning the dammages pretended. & further tht Capt Brent assured the deft, tht hee should not bee impleaded, or come to any dammage, touching any matter, tht should bee obiected agst him, for any such dammages wch was graunted.
