                  420     Court and Testamentary Business, 1648.

             

             Liber A. Mrs Margarett Brent on the behalfe of the Ld Propr prayeth

                   tht stoppige may bee made of a Cow & her increase now in the

                   possesn of Mr Thomas Copley, & darned by Willm Harditch &

                   intended to be transported out of this prouince by him Vntill

                   hee shall haue made his tytle better appeare thereunto, then as

                   yett he hath done, Conceyuing his Lp to haue an Interest in

                   all uncertaine tytles.

                    Attatchmt to the Sheriffe.

             

                    Willm Harditch petth to the Court to trauerse the Jury con

                   cerning his cause, now depending betwixt Capt Jno Price &

                   himselfe ffor tht as he affirmes all the Jury consented not, to

                   the gyuing in of the Verdict in the sd cause.

                    Barnaby Jackson one of the Jury, in the cause betweene

                   Capt Jno Price, & Willm Harditch, concerning an Anker of Sack,

                   deposed sayth, That uppon deliuery of the Verdict, touching

                   the sd cause, he doth know noe other, but tht they were all,

                   the whole twelue, agreed in one opinion, & tht there was not

                   any one of the sd Jury, did uary or alter from the ioynt opinion:

                   WCh was That they fownd for the plf nothing.

             

                    Willm Styles one of the Jury in caâ Supra, Sayth uppon his

                   oath That the cause was uoted amongst the Jury, & this dept

                   was of the lesser part. & tht he did not agree to the Verdict

                    was gyuen in by the fforeman.

                    And being further examined uppon oath, & demanded,

                   Whither he came into the Court, wth the rest of the Jury. Hee

                   affirmes, Yes. And tht he heard, the Gour demand of the Jury.

                   Whither or noe, They were agreed on their Verdict, & That he

                   heard the fforeman say, Yes. But himselfe sayd, Noe.

             

               p.  Walter Beane fforeman of the Jury, sayth Vppon his oath,

                   tht after altercaon concerning the Verdict in caã Supra. They

                   writt the Verdict, after brought into the Court in a paper. And

                   then one of the Jury Reading it alowd to them, demanded,

                   saying. Are we all agreed of this, & some answered, I, & hee

                   heard noe man say, Noe: whereuppon they brought it in; &

                   noe man moued att the rysing up, any further tarrying or con

                   sidering uppon it, in his hearing.

                   Mr Browne              Willm Hungerford

                               deposeth

                   Willm Marshall    . Stannop Roberts

               deposeth idem.                           idem.

                   Mr Brough              Nath: Joanes

                   Mr Jno Lewger

             

                    George Manners sayth uppon the demand. Hee heard Willm

                   Styles say, noe: But att the rysing up to deliur in the Verdict.

                   He heard noe man moue any further tarryance. & soe himselfe

                   came along, to the deliuery of the Verdict. In the rest he

                   agrees wth the fforernan.
