of Dead freight, proved by the plfs: oath, one hundd & sixty Liber A. pownds of casked Tob: being proportionable to the whole freight agreed uppon.
Zachary Wiade sayth uppon his oath in open Court, That a Red Cow, now in the possess of Capt Robt Vaughan, & lately gyuen by the late Gout deceased. unto the sd Capt Vaughan, by informaon tht it was one of his Lps stock: was att tht time none of his stock, but a Beast belonging to Mr Brent being one of them, tht was ceased to the Ld Proprs use, & allotted to Mr Brents share, out of Capt Cleyborne's cattle.
Capt Giles Brent complayneth agst Capt Robt Vaughan for wrongfully deteyning a Cow, & her encrease of the sd Capt Brents from him. from the yeare 1644 to this prnt day.
Zachary Wiade sayth uppon his oath in open Court, tht im mediately uppon the beginning of those troubles of this pmouince Mr Willm Cox came unto this deponent, being then in Mr Brents feud att Kent howse; & told him tht Mr Brent in the time of his being Gouernor had taken his cattle from him, & tht now he must haue them againe. And further tht he must haue a Cow of Mr Brent's owne stock in satisfaction for a Cow of his stock tht was myred, not long afore in the possesn of the sd Mr Brent. And tht further the sd Mr Cox asked this Dept to tell him, wch was a good Cow, of Mr Brent owne stock but whether hee had any such Cow he knoweth not. & further he sayeth not.
Vppon the complaynt abous the Dft denyeth to detayne any such cattle from the sd Mr Brent, But the Beast pretended vnto by the plf, was gyuen unto the dft, by the late Govt de ceased, as one belonging to his LPS stock. Vppon euidence produced vppon oath, tht the Cow in ques tion was not att tht time of his Lps stock, but of Mr Brents stock. The Gout iudged tht the deft should returne the sd Cow, wth her knowne encrease, unto the plf.
Henry Morgan Sheriffe of Kent County complayneth agst Tho: Munday for comming to exequute his office, in a com mand layd uppon him by the Comder of the sd County, much to the safety of the whole prouince, did wth uiolence presenting a gun agst him, wthstand the exequuon of the foresd command; bidding him goe from his howse about his busines: who after ward persisting in the exequuon of his office, was struck by the sd Munday. And therefore prayeth tht hee may haue re dresse from this Court, for the iniury susteyned therein. Vppon the complaynt aforesd Thomas Munday deft, denyeth p. 165
