382 Court and Testamentary Business, 1648.
Liber A. the Defts Attorney denyeth tht he tooke any out of the plfs possesn Jno Pyle deposed sayth tht he sold & deliuered one black pyed heighfer unto Robt Clarke Gentn about Nouembr last. Robt Clarke gent deposed sayth tht tht heighfer wch Jno Stur man now detayneth is the uery heighfer wch Mr Pyle sold him. Tho: Wagott deposed sayth tht he being att Mr Clarks howse eyther he the Sd Mr Clark or his wife demanded of this Dept if he had taken a pyed heighfer (now in dispute betweene him the sd Mr Clark & Jn Sturman) into his possesn & this Dept told him, Yes: & tht if shee came to any mishap, he told the sd Mr Clarke, tht he should not be damnifyed for tht the heighfer belonged to Mr Sturman. And the Jury fownd for the plf.
Wm Harditch attorney of Jno Sturman complayneth agst Robt Clarke gentn for deteyning one black pyed heighfer, & her calfe, wch belongeth to the sd Jno Sturman, & wth dammages for his staying here, by reason of the sd Vppon the compit aforesd Robt Clarke deft denyeth tht he hath any Beast belonging to Jno Sturman, But tht bee bought that Beast now in controursy of Mr Jno Pyle Mr Jno Pyle wanting euidence to make his right appeare vnto the sd Beast, the deft desyres a reference till June Court, by reason tht the euidence being out of the County, lesser time could not be admitted, & the Gour respited the cause accordingly.
