Marieland ss. Memorandum That the 16^th day of May in
the 42^th yeare of the dominion of Caecilius &c. Annoq Dni 1673
Came Jo. Bailey by Rob! Ridgeley his Attorney before the
Hon^ble Philip Calvert Esq Chancelor of this Province & Prayed
his Lordships Writ of error to him the s^d Jo. Bailey to be
graunted to the Justices of his Lordships Pro^all Court to be
directed to Require them the s^d Justices of the s^d Pro^all Court
to Send before his Lo^p in his Upper house of Assembly at his
Lordships Citty of S^t Maries the 26^th day of the same May
the Teno^r of the Record & Proceedings & Judgm^t of the s^t
Pro^al1 Court in a Cause lately there depending between one
Certaine Reymond Stapleforte Plaintife & the s^d. Jo. Bailey
Def' in a Plea of debt and it is graunted unto him The teno^r
whereof followeth in these words viz^t Caecilius Absolute Lord
& Proprietarie of Maryland & Avalon Lo. Baron of Baltemore
&c. To the Justices of o^r Pro^all C^rt of o^r s^d Province of Mary-
land Greeting Because in the Record & Processe as allsoe in
the Rendring of Judgm^t & graunting of Scire facias thereupon
before you in o^r s^d Court ag^t Jo. Bailey at the Suite of Rey-

mond Staplefort in a Plea of debt manifest Error hath happened
to the grea[te] damage of the s^d Jo. Bailey as by the greate
Compl^t [of the s^d] Jo. Bailey we have receaved We willing th^t
the E[rror (if any] be) should in due manner be Corrected &
full & Sp[eedy] Justice to be done to the s^d Parties in this
behalfe [we] Comand you th^t if Iudgm^t thereof be rendred
then the [Record] & Processe of the Judgm^t & Scire facias
afores^d w^th [all] thinges touching or Concerning the same to
us in of Upp[er] House of Assembly at o^r Cittie of S^t Maries on
the [ ] day of o^r s^d Assembly being the 26^th day of May
next under yo^r hands & Seales distinctly & openly you send
[that] Inspection being had of the Records & Proceedings
therein We may Cause further to be done what of Right &
according to the Lawes & ConstitucOns of this o^r Province ought
To be done therein & th^t you Cause the s^d Reymond Staple-
ford to be Sumoned to be then & there to heare the same &
allsoe th^t you have there this writ Witnes o^r Selfe at o^r Citty of
S^t Maries the 16^th day of May in the 42^th yeare of of Dominion
