there is Opposite to the s^d Land some Land th^t is not as yet
taken up w^ch is as Convenient for the Indians as th^t Land of
Billingsleys Therefore Humbly to desire his Excelency th^t he
would be Pleased to Appoint the Indians a habitacon upon th^t
Land they humbly Conceaving th^t to force anie to sell their
Land upon the Humour of the Indians may Prove of dangerous
Consequence to the Province in generall as being too much
Condescention of his Excelency to them & Sheweth too much
of feare to disoblige them

An Answ^r to w^ch vote was retorned by two members of their
own house viz^t Major Brooke & M^r Hatton as followeth viz^t
It is desired by this house th^t the Lower house will more Par-
ticularly informe this house where the Land said by them to be
Opposite to th^t of Billingsleys is Scituate & lyeing

Tylhmans Peticon & acco^t wherein the Countrey stood indebted
to him 25^th May Lower house This House [having] fully
examined the Acco^t within Specified & find [ing th^t] Jo. Tas-
well hath Paid him 3390^lb of tobaccoe [and that his] Excelency
& Councel have Paid him 6000^lb of tobaccoe [more] It is the
Judgm^t of this house th^t the s^d Tylhman [hath] rec^d full Satis-
facon for every Particular of the [Account] within written

This House doth Concurre w^th the Judgm^t & Opinion of
[the] Lower house & doe ord^r D^r Tylhmans Peticon & Account
[to] be delivered to him
This House rec^d from the Lower house by Major Bro[oke]
& M^r Hall the Answ^r to their last message about Billingsleys
land as followeth viz^t Upon the within written message from
the Upper house this house declares th^t the Land meant by
them to Lye opposite to Billingsleys Land is Part of the Ridge
mannor
This House having Considered the Vote of the Lower house
touching the Land of the Orphans of Major Billingsley desired
by the Mattopanie Indians doe Vote th^t the s^d Indians shall
have the s^d Land of Billingsley or else be removed to some
Part of the Land on the other side of the Creeke w^ch they have
not Sold according to their desire to the Govern^r & Councel in
Case they might not have the Land from Billingsleys Orphan
& doe further Vote th^t the s^d Indians shall not be Seated or
removed to the Land upon the Ridge mannor Ordered th?
the Secretarie be desired to Carrie this Vote to the Lower
House viz^t Voted by this house th^t an Act be Prepared to
