(237) Peace for this County that the above account is just and true that he hath not Received either part or parcel of the said account nor any Security or Satisfaction for the same and also made Oath that he hath just Reason to believe that the said Mark Knowles is Runaway These are Requiring you in his Lordships Name Immediately to Issue attachment against the Effects of the said Mark Knowles for the use of the said William Middleton as well for the Quantity of Eleven Hundred and Sixty Eight pounds of Tob.o Debt as also for all costs which shal arise on the said attachment fail not and this shal be your sufficient Warrant Wintness my hand the day and year above mentioned Rob Yates To the Clerk of Charles County This Whereupon It was Commanded the sheriff that of the Goods Chattles & Credits of the afs.d Mark Knowles in his Bailywick being he should attach as well the Sum of Eleven Hundred and Sixty Eight pounds of Tobacco Damages as Eight Hund.d Pounds of Tobacco for Costs that he had accrued and that further should in prosecution of the Preminses and when the same he had or any part thereof that he should have it before the Justices of the Lord Proprietary of his Next County Court to be holden at Charles Town on the Second Tuesday Next then and there to be Condemned According to Law to & for the use of the said William unless the said Mark should come then and there by himself or Lawfull Attorney and Answer unto the said William Midd of a plea of Trespass upon the Case and that by Good & Lawfull men of his Bailywick he should make to the Person or Persons in whose hands he should make the same attachment that he she or they be and appear before the Justices of the said Lord Proprietary at the place and Time afs.d to shew Cause if any his he or they have why the sum in their or any of their hands attached should not be Condemned according to Law and the said W.m have thereof Execution if &Ca and how he should Execute that Writt that he should make Known to the Justices afs.d at the time and Place afs.d and that he should have then and there that ^Writt^ and the Names of those before whom he should make Known &Ca And now here at this day to wit the second Tuesday in November afs.d Comes the said William by Jeremiah Chase his attorney & offers himself against the said Mark in the plea afs.d and the sheriff afs.d Returns to the Court here the Writt afs.d thus Endorsed Charles County ss.t I hereby Certifie to the Worshipfull the Justices within mentioned that by Virtue of the within Writt to me directed on the 14th Day of Sept.r 1747 I attached in the Hands of Philip Edelin the whole Damages & Costs within mentioned and on the 21.st of (the) |
