(106) June Court Anno Domini 1747 These are therefore in his Lordships (the Lord Proprys) Name to Command you to Issue Attachment against the Effects of the said James Scott as well to Satisfye the said Sum of Nineteen Pounds Two Shillings & Two Pence Current Money as also the Incidents Costs that shall accrue thereon pursuant to the Directions of the Act of Assembly in such Cases made and Provided fail not and for so doing this shall be your Warrant Given under my hand the 20.th of March 1747 Robt Hanson To the Clk of Charles County Whereupon It was Commanded the sheriff that of the Goods and Chattles & Credits of the afs.d James Scott in his Bailywick being he should attach as well the sum of Nineteen Pounds Two shillings and Two Pence Current money Damages as Two Thousand Pounds of Tobacco Costs that had accrued and that further should accrue in Prosecution of the Premises and when the same he had Attached or any Part thereof that he should have it before the Justices of the Lord Propry of his Next County Court to be held at Charles Town on the Second Tuesday in June Next then and there to be Condemned according to Law to and for the use of the said Mess.rs Falkner & Muschett unless the said James Scott should Come then and there or his Lawfull Attorney and answer unto the s.d Falkner Muschett of a Plea of Trespass upon the Case and that by Good & Lawfull men of his Bailywick he should make known to the Person or Persons in whose hand he should make the same Attachment that he she or they be and appear before the Justices of the said Lord Propry at the Place and time afs.d to Shew Cause if any he she or they have why the sum in their or any of their hands attached should not be Condemned according to Law and the said Falkner and Muschett have thereof Ex.n if &C.a and how he should Execute that Writt that he should Make Known to the Justices afs.d at the Place and Time afs.d and that he should have then and there that Writt & the Names of those before whom he should make the same known &Ca And now here at this day to wit the second Tuesday in June afs.d Comes the said Falkner & Muschett by Jeremiah Chase their attorney and offers themselves against the said James in the Plea afs.d and the sheriff afs.d Returns to the Court here the Writt afs.d thus Indorsed Vizt Charles County ss.t I hereby Certifie that by Virtue of the within Writt to me directed on the 7.th day of May 1747 I attached in the hands of Virlinder Sanders the whole Damages & Costs and I have also attached in the hands of Thomas Leftwich on the 18th day of May 1747 the whole Damages & Costs and I have also attached in the hands of Rob.t Whythill on the 18.th day of April 1747 the whole Damages & Costs and I have also Attached in the hands of Alexius Simms on the 15th day of April 1747 the whole Damages & Costs before Patrick Burn Edward Sanders Michael Tervill John Delozier John Howard & John Hanson ys.t and I have also attached in the hands of George Tarvin on the 3d day of April the whole Damages & Costs before Walter Dodson & Wm Middleton Jun I have also attached in the hands of Samuel Lackett on the 5.th of April the whole Damages & Costs before Robert Whythill and Wm Middleton Jun and I have also attached in the hands of John Beal Sen on that 9th day of April the whole Damages & Costs before John Hanson ys.t & Wm Middleton and I have also attached in the hands of John Mannery on the 18.th of Ap.l the whole Dam.s & Costs before John Muschett & Wm Middleton Jun & I have also attached in the hands of Samuel Hawkins on the 6.th of April the whole Dam.s & Costs before Walter Dodson & W.m Middleton Jun and I have also attached in the hands of Bart.a (Hatton) |
