(103 I hereby Certifie that Ledger Bin which the within Account Stands Stated to Janry the 20.th 1745/6 was Legally Prov'd as the Law Directs February 6.th 1745/6 before my self Jn.o Hawkins Junr Whereupon into Court here in his Proper Person Comes Richard Gray Jun of Charles County Planter and becomes Pledge & Security for the said Richard Gray Jun that if it should happen the said Richard in the Plea afs.d should be Convict that then the said Richard Gray Jun yielded & Granted that as well the Damages afs.d as all Costs which to the said Edward in this Part should be adjudged of his Lands & Chattles should be made and levied to and for the use of the said Edward that if it should happen the said Richard the Damages & Costs afs.d to the said Edward should not Pay or his body in to the Custody of the sheriff by Reason thereof Render And the afs.d Richard in his Proper Person Comes and defends the force and Injury when &C.a and says that he Cannot deny the Action afs.d of him the said Edward nor but that he did assume upon him self in manner and form as the said Edward against him hath Complained nor also but that the said Edward hath sustained Damages by means of not Performing the Promises & Assumptions afs.d to Twelve Hundred & forty four Pounds of Tobacco as the said Edward above in Declaring Supposes Whereupon the said Edward by his attorney aforesaid prays Judgment those Damages so acknowledged together with his Costs & Charges by him about his suit in this Part paid out & Expended to him to be adjudged Therefore it is Considered by the Court here that the said Edward do Recover against the said Richard his Damages afs.d to Twelve Hundred and forty four Pounds of Tobacco above acknowledged as also the sum of Three Hundred and forty five Pounds of Tobacco for his Costs & Charges by him about his suit in this Part laid out & Expended on his assent by the Deft in Mer Court here adjudged and the said Richard in mercy &Ca
Be it Remembered that Thomas Thompson Pursuant to the Directions of the Act of Assembly in those Cases late made & Provided lodged with the Clerk of the Court here the following account and Warrant p attachment Vizt 1746 M.r George Robinson To Thomas Thompson Dr August 24.th To my order payable to you on M.rs Sarah Warren ll Tob.o 1925 Charles County March the 16.th 1746/7 Then Came M.r Thomas Thompson before me the Subscriber one of his Lordships Justices for the County abovesaid and made Oath upon the Holy Evangelists of Almighty God that the above account is Just and true and that he Never Received any Part or Parcel thereof Sworn Before Jn.o Winter |
