Rose Roach
Somerset ss  Memorandum that at a Session of the peace of his Lordship the Right Honourable the

Lord proprietary of the province of Maryland held at dividing Creek in Somerset County the third tuesday
of November to witt the Eighteenth day of the same month Anno Dom one thousand seven hundred and forty before his said
Lordships Justices the peace in the County af.d to keep Assigned by the Oath of twelve Jurors being presented that Rose Roach
late of Somerset parish in the County af.d Spinster the tenth day January in the year of our Lord one thousand seven
hundred and thirty nine at the parish af.d in the County af.d and within the Jurisdiction of this Court did Comit fornication
with a Certain person to the Jurors af.d unknown and did permit the same unknown person then and there to have Carnal
knowledge of her body and then and there to beget a bastard Child on the body of her the same Rose to the high displeasure of
of Almighty God to to the Evill Example of all others in such Case offending Contrary to the peace of the said Lord proprietary
that now is his good rule and Goverment and Against the form of the Act of Assembly in such Case lately made and provided &c

                   Thereupon it is Command the sheriffe of Somerset County that he should take Rose Roach if she should be found in
his bailywick and her should safe keep so that he might have her body before the Justices of his Lordships County Court of Somerset
to be held at dividing Creek in and for the County af.d the third tuesday of March Anno Dom one thousand seven hundred and forty to
answer unto his said Lordship of the Indictment af.d &c

                      And now to witt the third Tuesday of March being the Seventeenth day of the same month
at a Court then held at dividing Creek in and for the County aforesaid before his Lordships Justices Came the
aforesaid Rose Roach in her proper person and had a hearing of the Indictment aforesaid   and for as much as
it doth appear to the Court here that the aforesaid Rose Roach had Committed fornication with a negro and by
such Inordinate Copulation had permitted herselfe to be begott with Child &a

             Therefore it is Considered by the Justices here that the Indictment aforesaid and all the proceeding
thereon be quashed and altogether held for nought and that the afd Rose Roach of the Indictmt aforesaid
be quiet   and Ordered that his Lordships attorney Exhibitt and Information against the said Rose Roach Immediately
for such her Inordinate Copulation as afd &c

Somerset ss.t  Be it Remembred that Robert Jenckins Henry Gent Attorney of the Right Honrble
the Lord proprietary that now is who for the same Lord proprietary in this part prosecuteth doth
Come here into the County Court of the same Lord proprietary held for Somerset County af.d (to witt)
at dividing Creek in the Same County the Seventeenth day of march in the year of our Lord one
thousand seven hundred and forty before Robert King Esq.r and his Associates the said Lord proprietary his Justices
of the same County Court and for the same Lord proprietary doth give the Court here to understand and be Informed that
Rose Roach late of Somerset Parish in the County af.d Spinster the tenth day of January in the year of our Lord one
thousand seven hundred thirty and nine she being a Mulatto Woman who then was and still is the servant of a Certain
Mary Fountain (untill she the said Rose shall attain the age of thirty and one years Eight years of which term is yet
to Come) within the Jurisdiction of this Court the day and year af.d at the place af.d did Comit Fornication with a Certain
negro Tom the slave of a Certain Nicholas Fountain and did permit the same negro Slave to have Carnall knowledge
of her body and then and there to beget a bastard Child on the body of her the same Rose to the high displeasure of
