141 in such Case Offending contrary to the peace of the said ^Lord^ proprietary that now is his good rule and Government ^and^ against the form of the act of assembly in such Case made & provided &a Test Mitchell Dashiell On the backside of the foregoing bill of Indictment it was thus Endorsed vizt Billa vera Edmond Hough Foreman Thereupon Command was given to the sheriff of Somerset County that he Should take the said Margarett Causey if &a to answer &a and afterwards to witt the Sixteenth day of march anno Dom One thousand Seven hundred and thirty five before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in and for the Same County Came the said Margaret Causey in her proper person according to a Certain Recognizance by her and her Security before acknowledged and had a hearing of the Indictment afd who thereupon Says that of the premisses afd in the Indictment afd mentioned above upon her Imposed she Indicted for but hath not wherewithall to pay her fine for the fact afd &a Wherefore it is Considered by the Court here that the said Margarett Causey be whipt at the publick whiping post with twenty Lashes on the Bare back well Laid on untill the blood appear and that she be taken &a and thereupon as to the Corporall punishment afd as by the Judgmt afd Rendered Command is Given to the sher of Somerset County that he do thereof Immediate Execution by whiping of the afd Marg.tt Causey at the publick whiping post with twenty Stripes on the bear back well Laid on untill the blood appear and afterwards in the Same Court Came the Said sheriff and made return that he had done the Execution of the Judgment aforesaid as to the Corporall punishment afd he was Commanded &a Whereupon it is Considered and ordered by the Court here that the said Margaret Causey give security for the payment of the Severall Officers their Fees due by means of the premises afd thereupon a Certain James Parrimore Late of Somerset County planter present here in Court in his proper person Acknowledged himselfe Indebted unto his Lordship the Lord proprietary in the Sum of five pounds sterling of his body goods and Chattells Lands and tenements to be made and Levied to the use of the sever.ll Officers of Somerset County Court In Case the said Margarett Causey do not pay unto the severall Officers their fees due upon the Indictment afd by occasion of the premisses afd &a
Jurisdiction of thir Court did commit Fornication with a Certain Margaret Causey and of her body then and there had carnal knowledge and a bastard Child on the body of her the same Margaret then and there did beget to the high |
