61 and Richard H. Battee & William L. Lowe trading under the firm of Battee & Lowe of the City of Baltimore of the other part Whereas the said Battee & Lowe owe and stand liable as acceptors of a draft drawn by the said Osburn S. Harwood on the said Battee & Lowe in farm of Sprigg Harwood for the sum of fifteen hundred dollars payable eight months after the date thereof the said Osbourn S. Harwood to save harmless indemnify and reimburse the said Battee & Lowe for and on account of their aforesaid liability hath agreed to execute these presents Now this Indenture Witnesseth that the said Osbourn S. Harwood for and in consideration of the above recited premises and of the sum of five dollars current money to him in hand paid by the said Battee & Lowe the receipt whereof is hereby acknowledged the said Osbourn S. Harwood hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Richard H. Battee & William L. Lowe their executors administrators and assigns his entire crop of tobacco now hanging in the houses and growing on his farm called Cherry Hill in Anne Arundel County. To have and To Hold the said crop of tobacco above bargained and sold or mentioned or intended so to be to the said Richard H Battee and William L Lowe their executors administrators and assigns forever And the said Osbourn S. Harwood for himself his executors and administrators the said crop of tobacco unto the said Richard H Battee & William L. Lowe their executors administrators and assigns against him the said Osbourn S. Harwood his executors and administrators and against all and every other person or persons whatsoever shall and will warrant and forever defend by these presents. In Witness whereof the said Osbourn S. Harwood hath hereunto set his hand and seal the day and year above written Signed Sealed & delivered in Os. S. Harwood (seal) the presence of Gassaway Winterson At the foot of the foregoing was thus written to wit State of Maryland Anne Arundel County to wit On this ninth day of september in the year 1845 personally appeared Osborn S. Harwood before the Subscriber a justice of the peace in and for the County and state aforesaid and acknowledged the aforegoing instrument of writing to be his act and deed. Acknowledged before Gassaway Winterson Recorded the fifteenth day of Sept 1845 "Paid" costs 75 cts |
