1997 LAWS OF MARYLAND

Commissioner extends the time for good cause" is added to reflect the
substance of former Art. 48A, § 357A(a)(5) and (c)(4), which authorized
"[t]he Commissioner [to] extend the time for filing for good cause".
Consequently, in subsections (a)(4) and (c)(3) of this section, the phrase
"unless the Commissioner extends the time for filing" is substituted for former
Art. 48A, § 357(a)(6) and (c)(5), which provided that the penalties for late
filing "do not apply if the nonprofit health service plan has obtained an
extension from the Commissioner for filing the required statement". Because
of this substitution, the exemption from payment of the penalties for late filing
when the Commissioner extends the time for filing applies to subsections
(a)(4)(i) and (ii) and (c)(3)(i) and (ii) of this section.

In subsection (a)(1) of this section, the reference to a "complete" statement is
substituted for the former reference to a "true" statement for clarity.

In subsection (a)(4) of this section, the reference to an "annual" statement is
substituted for the former reference to a statement "required under this
subsection" for brevity.

In subsection (b) of this section, the former reference to information that the
Commissioner considers "proper" is deleted as unnecessary in light of the
reference to information that the Commissioner considers "necessary".

Also in subsection (b) of this section, the former reference to the "period
between the filing of annual statements" is deleted as surplusage.

In subsection (c)(3) of this section, the reference to "July 10" is substituted for
the former erroneous reference to "March 10" for consistency within the
subsection.

In subsection (d) of this section, the reference to the "audited financial"
report is substituted for the former reference to a report "required under
subsection (c) of this section" for brevity.

As to the substitution of the reference to a corporation "authorized" under
this subtitle for the former reference to a corporation "licensed" under this
subtitle in subsection (f) of this section, see the General Revisor's Note to this
subtitle.
