1996 LAWS OF MARYLAND

REVISOR'S NOTE: Subsections (a) and (c)(2) and (3) of this section are new
language derived without substantive change from former Art. 48B, § 8(e).

Subsection (b) of this section is standard language added to conform to the
current practice of the Commissioner and to similar provisions governing
other State-regulated occupations.

Subsection (c)(1) of this section is new language added to state expressly that
which only was implied in the former law, i.e., that to renew a registration the
representative must otherwise be entitled to a registration.

Subsection (d) of this section is new language added to state expressly that
which only was implied in the former law, i.e., the Commissioner has a duty to
renew the registration of a representative if the licensee and representative
comply with this section.

In subsection (a) of this section, the former phrase "[u]nless revoked by the
Commissioner or unless the licensee by written notice to the Commissioner
cancels the representative's authority to act for it" is deleted as unnecessary.
A license that has been revoked or canceled is not in effect and therefore
cannot be renewed.

In subsection (c)(3) of this section, the reference to the registration "renewal"
fee is added for clarity.

26-306. CANCELLATION OF AUTHORITY OF REPRESENTATIVE.

IF A LICENSEE CANCELS A REPRESENTATIVE'S AUTHORITY TO ACT FOR THE
LICENSEE, THE LICENSEE IMMEDIATELY SHALL PROVIDE WRITTEN NOTICE OF THE
CANCELLATION TO THE COMMISSIONER.

change from former Art. 48B, § 8(d).

26-307. DENIALS AND REVOCATIONS.

(A) GROUNDS.

SUBJECT TO SUBSECTION (C) OF THIS SECTION, THE COMMISSIONER SHALL
DENY A REGISTRATION TO AN APPOINTEE OR REVOKE THE REGISTRATION OF A
REGISTERED REPRESENTATIVE IF THE COMMISSIONER, FOR CAUSE AND AFTER A
HEARING, DETERMINES THAT THE APPOINTEE OR REPRESENTATIVE:
