57. above described to the said John H. Harris, his Executors and Administrators and against all and every person or persons whomsoever shall and will warrant and forever defend by these presents: Provided Nevertheless that in case I the said William I Benjamin shall pay and satisfy to the said Jn.o H. Harris or his heirs, Executors, Adm.rs or Assigns the sum of $134.50 current money on or before the first day of April next with interest for the same and also the further sum of $160.00 current Money with interest due and to become due on the same on or before the first day of July next ensuing then this bill of sale to be void and of none effect it being the true intent and meaning thereof that said Horses & Carriages is Mortgaged by me to the said John H. Harris to secure the said Harris the payment of the Money afores.d And it is further agreed and expressly understood by the said William J. Benjamin that in case he shall fail to pay to the said Harris the afs.d sums of Money at the times set forth in this said Bill of Sale then and in that case the said Harris shall have full power and he is hereby fully authorised and empowered to advertise and sell the said Horses & Stage before described by his giving ten days notice of said sale and the over plus if any after paying off the within claims interest and costs is to be paid over to the said Benjamin. In Witness whereof I the said William J. Benjamin have hereunto set my hand and affixed my seal this 31 day of January 1848. Signed, sealed & delivered in the presence of Tho. H. Ford Robert Bell W.m K. Benjamin (Seale) State of Maryland Dorchester County, fs.t Be it remembered and it is hereby certified that on this first day of February in the year of Our Lord one thousand eight hundred and forty eight before the subscriber a Justice of the Peace of the said state and County aforesaid personally appeared William J. Benjamin he being known to me to be the person who is named and described as and professing to be a party to the foregoing Bill of sale and doth acknowledge the said Bill of sale or instrument of writing to be his act and deed. In testimony whereof I have hereto subscribed my name on the day and year afs.d Robert Bell J. P. State of Maryland Dorchester County ss.t Personally appeared before me Justice of the Peace for the County & state afs.d John Harris and made Oath on the Holy Evangels of Almighty God that the consideration named in the aforegoing Bill of sale is bona fide. State of Maryland Be it remembered that the following Bond &C was recorded Ex.d from 75 on the 19.th day of February 1848, To wit: Robert Bell & others Cambridge Dec.r 23.d 1847.
