WILLIAM DONALD SCHAEFER, Governor                            Ch. 184

(C) LICENSURE EXPIRES ON THE ANNIVERSARY DATE OF THE ORIGINAL
LICENSE UNLESS RENEWED FOR A 1 YEAR TERM. A PERSON MAY RENEW A LICENSE
IF THE PERSON MEETS THE REQUIREMENTS OF THIS SECTION AND THE
REGULATIONS ADOPTED UNDER THIS SUBTITLE.

(D) THE DEPARTMENT MAY INSPECT THE OPERATIONS OF EACH HOME
MEDICAL EQUIPMENT PROVIDER TO DETERMINE COMPLIANCE WITH THIS
SUBTITLE; AND

(E)     THE DEPARTMENT SHALL APPROVE, DENY, SUSPEND, OR REVOKE A
HOME MEDICAL EQUIPMENT PROVIDER'S LICENSE IN ACCORDANCE WITH
REGULATIONS ADOPTED UNDER THIS SUBTITLE.

(F)     A PERSON THAT PROVIDES HOME MEDICAL EQUIPMENT SERVICES
WITHOUT THE LICENSE REQUIRED UNDER THIS SUBTITLE IS GUILTY OF A
MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING $500.
EACH DAY A VIOLATION CONTINUES AFTER THE FIRST CONVICTION IS A SEPARATE
OFFENSE.

(G)     EXCEPT AS PROVIDED BY FEDERAL LAW, LICENSURE UNDER THIS
SUBTITLE DOES NOT ENTITLE A HOME MEDICAL EQUIPMENT PROVIDER TO
REIMBURSEMENT BY A THIRD PARTY PAYOR.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994.

(Senate Bill 494)

AN ACT concerning

Fish - Limited Entry to the Commercial Fishery -
Seasons, Gear, and Catch Limits

FOR the purpose of revising the tidal fish license requirements and fees; repealing
provisions for delayed entry to the commercial fishery; providing for a priority
system for entry into the commercial fishery; providing certain priorities for persons of
certain familial relationships to existing licensees;
repealing certain types of
commercial and noncommercial fishing licenses; requiring a tidal fish license for
certain fishing activities; requiring the Department to limit the number of tidal fish
licenses which may be issued; allowing all existing licensees to renew their license;
establishing certain requirements for the issuance of certain master fishing guide
licenses and exempting certain persons employed to operate a vessel for a master
fishing guide from the requirement to obtain a certain fishing guide license;
repealing certain free licenses; providing a certain waiver; authorizing crew
members under the tidal fish license; requiring soft shell crab shedders to be
licensed;
creating certain restrictions on catching of crabs for commercial purposes;
