REVISOR'S NOTE: Chapter______, Acts of 1993, which enacted Division I of the

State Personnel Article, also amended subsection (b) of this section to reflect
the reference, in former Art. 64A, §§ 2 and 4(3) and (7), to the unclassified
service status of certain positions and to clarify that other positions in the
Department are in the classified service.

The phrase "[e]xcept... as otherwise provided by law" is added to reflect other
laws that may affect the status of various employees. See, e.g., Title 1, Subtitle
4 of the State Personnel Article.

The former references to "deputy wardens", "assistant deputy wardens", and
"consulting physicians" are deleted as obsolete because these positions no
longer exist in the Department.

Article 33 - Election Code

2-6.

(A)     (1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION, THIS
SECTION APPLIES TO ALL EMPLOYEES OF AN ELECTION BOARD, INCLUDING CLERKS,
REGISTRARS, STENOGRAPHERS, AND VOTING MACHINE OPERATORS.

(2) SUBSECTIONS (A) THROUGH (F) OF THIS SECTION DO NOT APPLY TO
ANY ATTORNEY TO AN ELECTION BOARD OR TO ANY ELECTION JUDGE, BY ANY
TITLE.

(B)     THIS SECTION DOES NOT ALTER, IN ANY WAY, THE METHOD BY WHICH
THE SALARIES OF THE EMPLOYEES TO WHICH THIS SECTION APPLIES ARE
CURRENTLY FUNDED BY THE VARIOUS COUNTIES UNDER THIS ARTICLE.

(C)      [Subject to the provisions of Article 64A of the Code or, in the case]

(1)      IF THE EMPLOYEES of a board ARE covered by a [local] COUNTY
merit system [as provided in Article 64A, § 9G(f),]:

(I)      THE EMPLOYEES SHALL BE CLASSIFIED EMPLOYEES UNDER
THE COUNTY MERIT SYSTEM; AND

(II)     THE BOARD MAY APPOINT AND REMOVE THE EMPLOYEES
subject to the rules and regulations of the personnel officials of the county [in which]
WHERE the board is located[, each board may appoint and remove clerks, registrars,
voting machine custodians, stenographers, and other employees who].

(2)      IF THE EMPLOYEES OF A BOARD ARE NOT COVERED BY A COUNTY
MERIT SYSTEM:

(I)      THE EMPLOYEES SHALL BE IN THE CLASSIFIED SERVICE OF
THE STATE PERSONNEL MANAGEMENT SYSTEM; AND

(II)     THE BOARD MAY APPOINT AND REMOVE THE EMPLOYEES IN
ACCORDANCE WITH THE PROVISIONS OF THE STATE PERSONNEL ARTICLE THAT
GOVERN CLASSIFIED SERVICE EMPLOYEES.
