(2) THE DEPUTY IS IN THE UNCLASSIFIED SERVICE OF THE STATE
PERSONNEL MANAGEMENT SYSTEM AND SERVES at the pleasure of the Commissioner
[and shall not be subject to the provisions of Article 64A of this Code].

(C)      [He] THE DEPUTY shall be a person with adequate knowledge of penal
institutions and systems of prison-use and institution-use programs and with executive
experience therein.

(D)     (1) Subject to policy of the Division of Correction as established from time
to time by the Commissioner, [he] THE DEPUTY is generally in charge of administrative
procedures within the Division.                                   

(2) In the absence of the Commissioner, the deputy shall be acting
commissioner.                                                                                                           

REVISOR'S NOTE: Chapter, Acts of 1993, which enacted Division I of the

State Personnel Article, also amended this section to reflect the reference, in
former Art. 64A, § 6, to the unclassified service status of the deputy
commissioner and to make stylistic changes.                                 

684.                                                                                               

(b) (1) (I) Except for the positions [of Commissioner, deputy commissioner,
assistant commissioner, industries general manager, chaplain, warden, superintendent,
assistant warden, and assistant superintendent,] LISTED IN SUBPARAGRAPH (II) OF
THIS PARAGRAPH OR AS OTHERWISE PROVIDED BY LAW, all officers and employees of
the Department shall be appointed and removed by the Department in accordance With
the provisions of [Article 64A] THE STATE PERSONNEL ARTICLE THAT GOVERN THE
CLASSIFIED SERVICE.                                                                                           

(II) THE FOLLOWING POSITIONS ARE IN THE UNCLASSIFIED
SERVICE OF THE STATE PERSONNEL MANAGEMENT SYSTEM:         

1.        COMMISSIONER;

2.        DEPUTY COMMISSIONER;

3.        ASSISTANT COMMISSIONER;

4.        INDUSTRIES GENERAL MANAGER;

5.        CHAPLAIN;

6.        WARDEN;

7.        SUPERINTENDENT;

8.       ASSISTANT WARDEN; AND

9.       ASSISTANT SUPERINTENDENT.

(2) The warden or superintendent of each institution is the appointing
officer for employees of that institution, and the Commissioner is the appointing officer
for all other employees in the Department.
