THE BOARD OF LICENSE COMMISSIONERS [may not be issued by] SHALL ISSUE A
CERTIFICATE OF APPROVAL FOR PRESENTATION TO the Clerk of the Circuit Court
DIRECTOR OF FINANCE, WHO MAY NOT ISSUE A LICENSE unless and until there is
presented to [him] THE CLERK DIRECTOR ALSO a certificate, issued by the Bureau of
Assessments, showing that there are no unpaid taxes on the merchandise, fixtures and
stock of the applicant due to the City of Baltimore or the State of Maryland.
(P) IN SOMERSET COUNTY, THE COUNTY TREASURER SHALL ISSUE A LOCAL
LICENSE UNDER THIS ARTICLE:
(1) ON THE APPROVAL OF THE APPLICATION BY THE BOARD OF
LICENSE COMMISSIONERS; AND
(2) ON THE PAYMENT OF THE FEE FOR THE LICENSE.

(a) In those counties having no board of license commissioners and no other
procedure for the issue of licenses, at least two weeks before the clerk shall issue any
license, he shall cause a notice of the application to be advertised two times in some
newspaper published or generally circulated in the county or city in which the licensed
place of business is proposed to be located, and the said notice shall indicate that the
license will be granted unless a written protest is filed with the clerk of the court, on or
before the expiration of two weeks from the date of the first publication. If no written
objections are filed with the clerk before the expiration of the time specified in the
publication of notice, the clerk shall forthwith issue the license applied for, upon payment
of the fee required.
(b) A protest shall not be valid to delay the issue of such a license unless the same
has been signed by ten or more reputable citizens of the State who are real estate owners
in the voting precinct in which the business sought to be licensed is to be carried on.]
63.
(a) Except as otherwise provided in this section, the [clerk] LOCAL
COLLECTING AGENT shall remit all license fees collected [by him, less a commission of
5 percent for the issuance of each license] UNDER THIS ARTICLE, to the board of county
commissioners for the county, or to the Mayor and City Council of Baltimore, as the case
may be; and the board of county commissioners or Mayor and City Council of Baltimore
shall use the portion of the receipts as may be necessary to pay refunds as hereinafter
provided, and devote the balance to the general purposes of the county or city, as the case
may be.
(A-1) IN BALTIMORE CITY, THE CLERK OF THE CIRCUIT COURT SHALL PAY
INTO THE GENERAL FUND OF THE STATE 5% OF THE LICENSE FEES COLLECTED BY
THE CLERK.
