WILLIAM DONALD SCHAEFER, Governor Ch. 220

(1)  Unusual or temporary income items; AND

(2)  Long-term unusual expenses such as medical,
rehabilitation, or special education expenses[;].

[(3) Allowances for dependents and family size.

(c)   "Department" means the Department of Housing and
Community Development.

(d)  (1) "Group home" means a housing facility offering:

(i) Common, shared or independent living,
dining, kitchen, sanitary, and sleeping facilities; and

(ii) Supportive services____or____supervisory

personnel to individuals with special housing needs where the
individuals are not related to the group home sponsor.

(2)  Subject to the approval and permitting procedures
of the local zoning authority, a "group home" that will house 4
or more individuals may provide in a minor portion of the
building's space for nonresidential uses, which are in
conformance with local zoning requirements, that may not be
directly related to the housing facility, but which offer goods
or services for the benefit of limited income or otherwise
disadvantaged persons.

(3)  A group home need not include all of the
facilities described in paragraph (l)(i) of this subsection if it
provides emergency and temporary housing facilities for homeless
persons.

(e)   "Group home sponsor" means a borrower under the program
who owns and operates a group home and who is;

(1)  A nonprofit organization;

(2)  An individual; or

(3)  A limited partnership if;

(i) All the general partners qualify as a
nonprofit organization; and

(ii) The limited partnership is formed for the
purpose of undertaking a group home project that is eligible in
whole or in part for federal low-income housing tax credits.]

(C) "HOUSEHOLDS OF LIMITED INCOME" MEANS AN     INDIVIDUAL OR

INDIVIDUALS WHOSE ADJUSTED ANNUAL INCOME DOES   NOT EXCEED THE

UPPER INCOME LIMITS ESTABLISHED BY THE SECRETARY     IN ACCORDANCE
WITH § 2-604(5) OF THIS SUBTITLE.
