Ch. 122

LAWS OF MARYLAND

(c)  "Central repository" means the criminal justice
information system central repository created by § 747(b) of this
article.

(d)   "County" includes Baltimore City.

(e)   "Criminal history record information" means data
initiated or collected by a criminal justice agency on a person
pertaining to a reportable event and includes data from an agency
that is required to report to the central repository under Title
12 of the Health - General Article. The term does not include:

(1)  Data contained in intelligence or investigatory
files or police work-product records used solely for police
investigation purposes;

(2)  Data pertaining to a proceeding under Subtitle 8
of Title 3 of the Courts Article (Juvenile Causes), but it does
include data pertaining to a person following waiver of
jurisdiction by a juvenile court;

(3)  Wanted posters, police blotter entries, court
records of public judicial proceedings, or published court
opinions;

(4)  Data pertaining to violations of the traffic laws
of the State or any other traffic law, ordinance, or regulation,
or violations of any local ordinances, or any State or local
regulations, or violations of the Natural Resources Article or
public local laws[, unless the individual is arrested on a bench
warrant issued for failure to appear in court or obey a court
order for any such violation, or unless the individual is
committed to a correctional facility upon conviction for any such
violation];

(5)  Data concerning the point system established by
the Motor Vehicle Administration in accordance with the
provisions of Title 16 of the Transportation Article; OR

(6)  Presentence investigation and other reports
prepared by a probation department for use by a court in the
exercise of criminal jurisdiction or by the Governor in the
exercise of his power of pardon, reprieve, commutation, or nolle
prosequi[; or

(7)  Data contained in current case-in-progress
systems or records pertinent to public   judicial proceedings which
are reasonably contemporaneous to the event to which the
information relates].

(f)   "Criminal justice agency" means any government agency
or subunit of any such agency which is authorized by law to
exercise the power of arrest, detention, prosecution,
