in diesel engines or in internal combustion engines for the
propulsion of motor vehicles, including any product obtained by
blending together any one or more products of petroleum with or
without other products, if the resultant product is capable of
the same use.
(3)](1) "Jobber"--shall mean and include any person,
firm or corporation who buys motor vehicle fuel from a duly
licensed motor VEHICLE fuel dealer, tax paid for resale or
redistribution at wholesale and whose sales of gasoline equal or
exceed 50 percent of the total gallons of [petroleum products]
MOTOR VEHICLE FUEL purchased.
[(4)] (2) "Heating oil distributor"--shall mean and
include any person, firm or corporation who buys heating oils or
kerosene for resale or redistribution and whose primary business
is the resale or redistribution of heating oils or kerosene.
[(5)] (3) "Sale"--shall mean and include any exchange,
gift or other disposition, and "purchase" shall include any
acquisition of ownership.
[(6)](4) "Retail service station dealer"--shall mean
and include any person, firm or corporation maintaining a place
of business where motor vehicle fuel is sold and delivered into
the tanks of motor vehicles.
[(7)](5) "Manufacturer and refiner"—shall mean and
include any person, firm or corporation engaged in producing,
[blending] REFINING, or compounding motor vehicle fuels in this
State.
[(8)](6) "Person"--shall mean and include
partnerships, firms, associations, companies, corporations and
shall, also, be construed to import both the plural and singular
as the case demands.
[(9)](7) "Motor fuel wholesaler"--shall mean and
include any motor VEHICLE fuel dealers as defined in § 135 of
Article 56 of the Annotated Code of Maryland.
[(10)](8) "Peddler" means any person, firm, or
corporation having no storage facility other than trucks who
purchases [kerosene, heating oil, or] motor vehicle fuel from a
licensed motor VEHICLE fuel dealer, SPECIAL FUEL SELLER, jobber,
or heating oil distributor for resale or redistribution.
[(11)](9) "Major brand" means the primary trade name
or trademark most commonly associated" with and identified with a
manufacturer and refiner's retail service station.
[(12)](10) "Secondary brand" means a trade name or
trademark, other than a major brand, used to identify a
manufacturer and refiner's retail service station.
