NEEDS OF DOMICILIARY CARE FACILITY CONSUMERS, PROVIDERS, AND
RELATED PROGRAMS;
(4) REVIEW AND APPROVE POLICIES AND REGULATIONS
GOVERNING DOMICILIARY CARE FACILITIES AND RELATED PROGRAMS; AND
(5) EXERCISE BINDING AUTHORITY REGARDING INTERAGENCY
ISSUES ESTABLISH APPROPRIATE INTERAGENCY AGREEMENTS RELATIVE TO
DOMICILIARY CARE.
(B) THE BOARD CONSISTS OF 9 VOTING MEMBERS AS FOLLOWS:
(1) THE SECRETARY OF STATE PLANNING, WHO SHALL BE
CHAIRPERSON OF THE BOARD;
(2) THE SECRETARY OF HEALTH AND MENTAL HYGIENE;
(3) THE SECRETARY OF HUMAN RESOURCES;
(4) THE DIRECTOR OF THE OFFICE ON AGING; AND
(5) 2 CONSUMER MEMBERS, INCLUDING ONE WHO IS A
REPRESENTATIVE OF THE MARYLAND DISABILITY LAW CENTER.
(C) SUBJECT TO SUBSECTION (D) OF THIS SECTION, THE GOVERNOR
SHALL APPOINT 3 NONVOTING MEMBERS OF THE BOARD AS APPROPRIATE
AFTER CONSIDERING INDIVIDUALS RECOMMENDED BY ORGANIZATIONS
REPRESENTING CONSUMERS, PROVIDERS, AND THE COMMUNITY AT LARGE.
(D) (1) OF THE MEMBERS APPOINTED BY THE GOVERNOR UNDER
SUBSECTION (C) OF THIS SECTION, FROM INDIVIDUALS RECOMMENDED BY
ORGANIZATIONS, THE GOVERNOR IS NOT RESTRICTED TO THOSE
RECOMMENDATIONS IN APPOINTING MEMBERS.
(5) 1 REPRESENTATIVE OF THE DISABILITY LAW CENTER
APPOINTED BY THE GOVERNOR;
(6) 1 DOMICILIARY CARE FACILITY PROVIDER APPOINTED BY
THE GOVERNOR; AND
(7) 3 CONSUMER MEMBERS APPOINTED BY THE GOVERNOR.
(C) THE GOVERNOR SHALL APPOINT THE PROVIDER AND CONSUMER
MEMBERS FROM THE RECOMMENDATIONS OF ORGANIZATIONS REPRESENTING
DOMICILIARY CARE FACILITY PROVIDERS AND CONSUMERS. HOWEVER, THE
GOVERNOR IS NOT RESTRICTED TO THESE RECOMMENDATIONS IN APPOINTING
MEMBERS.
(2) (D) (1) THE TERMS OF THE MEMBERS WHO ARE NOT
CABINET MEMBERS, OR WHO DO NOT REPRESENT THE MARYLAND DISABILITY
LAW CENTER, SHALL BE 4 YEARS BEGINNING JULY 1, 1986.
(3) (2) EACH MEMBER OF THE BOARD SHALL SERVE WITHOUT
COMPENSATION BUT SHALL BE ENTITLED TO REIMBURSEMENT FOR EXPENSES
UNDER STANDARD STATE TRAVEL REGULATIONS.
