WHEREAS, The Joint Committee on Administrative,
Executive and Legislative Review recommends that this Bill
be enacted on an emergency basis in order to provide a legal
foundation for the practice of nurse midwifery until the
necessary regulations for the governance of the practice of
nurse midwifery are developed and promulgated; now,
therefore,
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That:
(a) A licensed nurse midwife who was licensed by the
law that regulated midwifery on or before July 1, 1978
remains governed by that law until rules and regulations to
regulate the practice of nurse midwifery are adopted jointly
by the State Board of Examiners of Nurses and the State
Board of Medical Examiners and become effective.
(b) A licensed nurse midwife who was licensed by the
law that regulated midwifery between July 1, 1978 and July
1, 1981, inclusive, remains governed by that law until rules
and regulations to regulate the practice of nurse midwifery
are adopted jointly by the State Board of Examiners of
Nurses and the State Board of Medical Examiners and become
effective.
(c) An unlicensed person who began the practice of
nurse midwifery after July 1, 1981, but before January 14,
1982, may continue to practice midwifery until rules and
regulations to regulate the practice of nurse midwifery are
adopted jointly by the State Board of Examiners of Nurses
and the State Board of Medical Examiners, if that person:
(1) Is licensed by the State Board of Examiners
of Nurses to practice registered nursing; and
(2) Is certified by the American College of
Nurse-Midwifery as a nurse midwife.
(d) The provisions of this Act relating to the joint
promulgation of rules and regulations governing nurse
midwives apply only to delegated medical functions. All
other rules and regulations governing nurse midwives shall
be promulgated solely by the State Board of Examiners of
Nurses.
(e) This Act shall become null and void without any
further action by the General Assembly on the earlier of the
following 2 dates:
(1) The effective date of rules and regulations
adopted jointly by the State Board of Examiners of Nurses
and the State Board of Medical Examiners for the purpose of
governing the practice of nurse midwifery; or
