1-104. Responsibilities and Duties of Secretary.
(j) Exercise of powers, etc., of certain
agencies.--The Secretary may exercise or perform any power,
duty, responsibility, or function which any of the following
units, or their successors, may exercise or perform: Bureau
of Mines, the Maryland Geological Survey, the Fisheries
Administration, the Wildlife Administration, the natural
resources police force, the Forest Service, the Park
Service, the Water Resource Administration, the Maryland
Environmental Service, AND the power plant siting program!,
and the Maryland State Board of Well Drillers].

3-105. Responsibilities and activities; limitation upon
powers.
(d) To the extent appropriate in each instance,
acquisition, design, construction, reconstruction,
rehabilitation, improvement, operation, maintenance, and
repair of a water supply project, wastewater purification
project, and solid waste disposal project, pursuant to an
order of [either] the Secretary of Health and Mental Hygiene
[or the Secretary of Natural Resources] as further provided
in §§ 3-110 and 3-111 of this subtitle; or pursuant to a
mandatory agreement to provide requested services, as
provided in § 3-108 of this subtitle; or pursuant to an
approved five-year plan, as provided in § 3-106 of this
subtitle.
3-111. Pollution abatement projects to be provided upon
directive of Secretary of [Department of Natural Resources]
HEALTH AND MENTAL HYGIENE; Costs and operation of projects.
(a) Upon the failure of a person to comply with an
order to abate pollution provided for in Title 8 of this
article, the Secretary of [Natural Resources] HEALTH AND
MENTAL HYGIENE, if no remedy provided in Title 8 of this
article is sought against that person, may direct the
service to provide projects necessary to abate the
pollution.
(b) Upon receipt of the directive from the Secretary
of [Natural Resources] HEALTH AND MENTAL HYGIENE, the
service shall provide the project necessary to abate the
pollution, and the person shall discharge or deliver his
wastes only to a service project or avail himself of the
projects provided by the service to abate the pollution. The
cost of projects provided by the service to abate pollution
under the terms of this section shall be borne by the person
against whom the order to abate pollution was issued. That
