Ch. 306

RULES, REGULATIONS, GUIDELINES, AND DIRECTIVES FOR
IMPLEMENTING THE STATE'S POLICY AGAINST DISCRIMINATION.

ANY STATE AGENCY RECEIVING A COMPLAINT OF
DISCRIMINATION BASED ON POLITICAL OR RELIGIOUS OPINION OR
AFFILIATION, MARITAL STATUS, PHYSICAL OR MENTAL HANDICAP,
RACE, COLOR, NATIONAL ORIGIN, SEX, AGE, OR OTHER NONMERIT
FACTORS SHALL PROMPTLY ADVISE THE EQUAL EMPLOYMENT
OPPORTUNITY COORDINATOR IF THE COMPLAINT INVOLVES
DISCRIMINATION IN STATE EMPLOYMENT.

THE SECRETARY OR OTHER CHIEF EXECUTIVE OFFICER OF EACH
DEPARTMENT IN THE EXECUTIVE BRANCH SHALL APPOINT AN
ASSISTANT SECRETARY OR SOME OTHER EMPLOYEE OF EQUAL STATURE
WITHIN THE DEPARTMENT AS FAIR PRACTICES OFFICER. THE FAIR
PRACTICES OFFICER SHALL BE CHARGED WITH THE IMPLEMENTATION
OF THIS PROGRAM AND THE AFFIRMATIVE ACTION PLAN ADOPTED
PURSUANT TO SECTION 12B WITHIN THE DEPARTMENT INCLUDING BUT
NOT LIMITED TO THE DEVELOPMENT AND CONDUCT OF PLANS,
PROGRAMS, AND POLICIES TO ESTABLISH AND PROMOTE
NONDISCRIMINATORY EMPLOYMENT AND PERSONNEL PRACTICE WITHIN
THE DEPARTMENT. THE DEPARTMENTAL FAIR PRACTICES OFFICER
SHALL COOPERATE AND COORDINATE ACTIVITIES WITH THE EQUAL
EMPLOYMENT OPPORTUNITY COORDINATOR.

EACH DEPARTMENT OF THE EXECUTIVE BRANCH AND EACH AGENCY
NOT INCLUDED WITHIN A DEPARTMENT SHALL REPORT ANNUALLY TO
THE GOVERNOR BY JANUARY 1, ALL ACTIVITIES UNDERTAKEN DURING
THE PAST YEAR TO IMPLEMENT THE EQUAL EMPLOYMENT OPPORTUNITY
PROGRAM. THE REPORT SHALL COVER BOTH INTERNAL PERSONNEL
PRACTICES AND EXTERNAL RELATIONSHIP WITH OTHER STATE
AGENCIES. A COPY OF EACH REPORT SHALL BE FURNISHED TO THE
EQUAL EMPLOYMENT OPPORTUNITY COORDINATOR AND THE MARYLAND
COMMISSION ON HUMAN RELATIONS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
