June Court 1701 59 And now here at this Day vizt. ye 24 Day of June Annoq Domi. 1701 ye Said Thomas Tolley Appeares According to Indictment which was as followes
Tolley on ye Kings high way there in A riatous Manner did assault ye bodie of A Certain Neale O’Neale and him ye Said Neale O’Neale did beate wound & evill intreat and other enormities comitted agt. ye peace of our Soveraigne Lord ye King and at. ye force of ye Act of Assembly in that case made & provided Macklin pr Doms. Rege To which Indictment ye Said Thomas Tolley pleads not Guilty & for Tryall putts himselfe upon God & ye Country Tolley pr pr And he followes for our Lord ye King Sayes he is Guilty Macklin pr Doms. Rege Comand was Therefore given to ye Sherf. of Kent County that he cause to Come here Twelve &a. by whom &a. who neither &a. To recognize &a. and ye Said Sherf. made Answer he had there ready Twelve &a. as by his precept he was Comanded vizt. Thomas Wyatt foreman Nicholas Massey Christopher Pinder William Sigley Henry Green Nathanll. Cleave Thomas Carman Thomas Hynes Thomas Ruth Thomas Ford Thomas Smith and John Ponder which Jury being duly Sworne to Try ye Issue Joyned and having heard ye pleadings Evidence ye Court giveth them theire Charge who withdraw to Consider on ye premisses and After Some Short time doe again[e] returne and being Called over as alsoe ye Defendt. and being demanded whither ye Said Defendt. was Guilty or not Guilty as he Stood Indicted doe Say that he is Guilty & by Thomas Wyatt theire foreman all of them Soe Say Therefore it is Considered by ye Court here vizt. this Twenty fifth Day of June Annoq Domi. 1701 in reguard that ye Said Defendt. Thomas Tolley has Submitted unto ye Court as to this Indictment goe thereof without Day paying his fees Amounting to ye Sume of Eight hundred & Six pounds of Tobo. Accrewing upon ye Said Presentment Jno Dowdall Clk Richard Parnes Sone of Richard Parnes late of this County Decd. comes into Court & makes Choice of Nicholas Hurt for his Guardian The Court Adjournes untill Six A Clock to Morrow Morning June ye 25. 1701 The Court againe Mett
