59 June Court 1701 Att which next Court vizt. ye 24th. Day of June Annoq Domi. 1701 came Elias King high Sherf. of Said County & made returne thereof in these words Sumoned Elias King Sherf. And now here at this Day vizt. ye 24th. Day of June Annoq 1701 came ye Said Thomas Tolley in his proper person and being called Appeares According to Indictment which as followeth
majties Justices of this Court out of ye hands of A Certaine Dorothy Tudor Did forciblely take & beare Away agt. ye peace of our Soveraigne Lord ye King & at. ye forme of ye Act of Assembly in that Case made & provided Macklin pr Doms Rege To which Indictment ye Said Thomas Tolley pleads not Guilty & for Tryall puts himself upon God & ye Country Tolley pr pr and he followeth for our Lord ye King Sayes he is Guilty Macklin pr Doms. Rege Comand was therefore given to ye Sherf. of Kent County that he cause to come here Twelve &a. by whom &a. who neither &a. To recognize &a. and ye Said Sherf. made answer he had there ready Twelve &a. as by his precept he was Comanded vizt. Thomas Wyatt Foreman Nicholas Massey Christopher Pinder William Sigley Henry Green Nathanll. Cleave Thomas Carman Thomas Hynes Thomas Ruth Thomas Ford Thomas Smith and John Ponder which jury being duly Sworne to Try ye Isue Joyned and having heard ye whole matter ye Court giveth them theire Charge who withdraw to Consider on ye premisses and after Some Short time doe againe returne and being Called over as alsoe ye Said Defendt. and being Demanded whither ye Said Defendt. was Guilty as presented doe Say he is Guilty and by Thomas Wyatt theire foreman all of them Soe Say Therefore it is Considered by ye Court here vizt. ye Twenty fifth Day of June Annoq Domi. 1701 as to ye Said Indictmt. ye Said Thomas Tolley upon his Submission here in open Court goe thereof without Day paying ye Sume of Eight hundred & Six pounds of Tobo. fees Accrewing upon ye Said Prsentment Jno Dowdall Clk Thomas Tolley being presented Together with Three of his Men for that they did Contrary to his Majties Peace Assault ye bodie of A Certaine Neale o’Neale on his Majties highway which presentmt. was Signed billa vera pr Jno Chaires Foreman Comand was given to ye Sherf. of Kent County ye 28 day of March Annoq Domi. 1701 that he cause him if found in yr. bailiwick Soe that he be & Appeare at ye Next Court to be held for Said County Att which Next Court vizt. ye 24 Day of June Annoq Domi. 1701 came Elias King high Sherf. of Said County being ye day of ye returne of Said writt & made returne thereof thus endorsed Sumoned Elias King Sherf. |
