661 Man named Bob one Negro Lad named Jack one other Negro Lad named Great Jacob one other Negroe Lad named Little Jacob one other Negroe Boy named Will one Negroe Woman named Priss To have and to hold the said several Tracts or Parcels of Land & Negroes with their Increase and all and singular the Appurtenances unto the same belonging unto him the said Caleb Dorsey his Heirs and Assigns forever to the only Use and Behoof of him the said Caleb Dorsey his Heirs and Assigns for ever under the Proviso or Condition that if the said Fielder Gaunt his Heirs or Assigns shall and did well and truly pay or cause to be paid to the said Caleb Dorsey his Heirs Executors Administrators or Assigns the said Sum of one thousand and fifty four Pounds five Shillings Sterling Money on the fifteenth Day of April which should be in the Year One thousand seven hundred and sixty eight together with lawful Interest for the same then the said Indenture should be void And Whereas afterwards to wit on or about the second Day of June seventeen hundred and sixty eight the said Principal Money and Interest thereon not then having been paid to the aforesaid Caleb Dorsey he the same Fielder Gaunt by Deed of Indenture duly acknowledged and recorded in the Records of Frederick County Court aforesaid reciting as therein is recited and for the Consideration therein mentioned did give grant bargain & sell alien release enfeoff confirm transfer assign and set over unto the aforesaid Edward Gaunt his Heirs Executors Administrators and Assigns amongst other Things all and each and every of the Lands mentioned to be granted bargained sold aliened enfeoffed and confirmed in and by the said Indenture to the said Caleb Dorsey and also all Negroes mentioned or intended to be granted bargained sold assigned transferred or set over to the said Caleb in or by the said Indenture to him for the Purposes and upon the Trust in the said Deed intended to the aforesaid Edward Gaunt mentioned And Whereas the said Caleb Dorsey afterwards by Suit at Law got and obtained the Negroe Slaves aforesaid and hath held and yet holds them in Possession and hath also prosecuted a Suit in the High Court of Chancery against the said Fielder Gaunt to foreclose and barr his Equity of Redemption in and to the Lands and Negroes mortgaged to the said Caleb Dorsey as aforesaid in which Suit an Account is ordered to be taken but the same is not yet adjusted so that the Ballance due to the said Caleb Dorsey on his said Mortgage cannot be ascertained And whereas the aforesaid Bartholomew Booth hath ^agreed^ with the aforesaid Fielder Gaunt for the Purchase of the Forest of Needwood Hawkins's Plains and fifty four Acres and one half Acre of Swedes March part of the Lands contained in the Mortgage aforesaid to the aforesaid Caleb Dorsey Begining (at) |
