466 either in Maryland or the ^said^ three Counties of Newcastle Kent and Sussex and Delaware belonging or which did belong to the said Thomas Lightfoot and William Lightfoot in the Lifetime of the said William or belonging to him the said Thomas Lightfoot wither by descent Inheritance purchase devise or otherwise howsoever unto the said Walter Franklin his heirs and assigns to the only proper use Benefit and Behoof of the ^said^ Walter Franklin his Heirs and assigns for ever And to have and to hold all and singular the said personal Estate of every Nature and kind whatsoever before mentioned unto the said Walter Franklin his Executors Administrators and Assigns for ever And the said Thomas Lightfoot for himself his Heirs Executors and administrators doth hereby Covenant grant and agree to and with the said Walter Franklin his heirs and assigns That he the said Thomas Lightfoot hath not done or Committed or Caused or procured to be done suffered or Committed any act Deed Matter Cause or thing whereby the said premisses above mentioned and hereby released or assigned or any part thereof are can shall or may be in any wise impeached impaired altered charged incumbered or diminished in Title Estate or otherwise And the said Thomas Lightfoot doth hereby nominate appoint and authoirize and make the said Walter Franklin to be his true and Lawfull Attorney in his Name and Stead to ask demand sue for levy recover have receive and take all Debts dues sum or sums of Money Damages & demands whatsoever due owing payable and belonging to the said Thomas Lightfoot and Company or as survivor of the said Thomas and William Lightfoot and to give and sufficient Releases and Discharges for the same or any part or partel thereof in the Name of him the said Thomas Lightfoot or otherwise and attornies one or more under him the said Walter Franklin for the purposes aforesaid to make and constitute and again at pleasure to revoke; and to do perform and finish every other matter or thing that he the said Walter Franklin or any of his substitutes shall think necessary to be done in and about the said premisses as fully and amply as he the said Thomas Lightfoot could do, if personally present In Witness whereof the said parties to these presents have to these presents interchangeably set their hands and seals the day and year in this Indenture first written Tho Lightfoot (seal) Sealed and Delivered in the presence of us it being declared as a farther Consideration the money the said Walter may hereafter pay on account of the Company Debts John T Myers John Franklin John McHesson On the Back of the aforegoing Deed was thus endorsed (Viz.t) Received of the within named Walter Franklin on the day of the date of the within Indenture the Sum of Five pounds for the Consideration money therein mentioned And a farther Consideration is the Monies that the said Walter is to pay for Debts due from the Company on account of Company Debts Witnesses Tho Lightfoot John T Myers John Franklin John McKesson |
