452 said Writing and Made this Acknowledgement of her Own free Will and Accord and without any Compultion from her said Husband or for Fear of his Displeasure Recorded the 21.st day of October Geo Steuart Examd This Indenture Made the Twenty sixth Day of September in the Year of our Lord One Thousand Seven Hundred and Sixty Eight Between Thomas Gist of Baltimore County in the Province of Maryland (Farmer and Planter of the one Part and Mordecai Gist of said County and Province Merchant of the other Part Witnesseth that the said Thomas Gist for and in Consideration of the Sum of Twenty Pounds Sterling Money of Great Britain to him in hand Paid by the said Mordecai Gist the Receipt whereof he the s.d Thomas Gist doth hereby Acknowledge and thereof doth clearly Acquit and discharge the said Mordecai Gist his Heirs Exer.s Admr.s and by these Presents hath given granted Bargained Sold Aliened Enfeoffed and Confirmed and by these Presents Hath given granted Bargained Sold Aliened Enfeoffed and confirmed and by these Presents doth fully and Absolutely give grant Bargain Sell Alien Enfeoffe and Confirm unto him the said Mordecai Gist Part or Parcell of a Tract of Land Called the Resurvey on Lime Pitt Lying and being in Frederick County and Province aforesaid Beginning at the End of Twenty five Perches of the first Line of the Original Resurvey and running thence with said Line South fifty two Degrees East Thirty Eight Perches to the End of said Line thence South Eighty one Degrees East Ninety Perches then South Sixteen Degrees East Sixty Nine Perches then North Seventy five Degrees West Ninety Perches then North Forty Eight Degrees West Sixteen Perches then South West Eighty Perches then North West Forty Perches then South West Eighty Perches then South East Eighty Perches then South Fifty four degrees East Seventeen Perches then South Sixty Six degrees West forty perches then South Forty four degrees West forty Perches then South Eighty five degrees West thirty Four Perches then North Twenty degrees West Forty Perches then South West Sixty two Perches then North Forty five degrees West Sixty three Perches then North Forty five degrees East Seventy two Perches then North Twenty two and a halfe degrees West Seventy two Perches and then with a Streight Line to the Begining Containing and now Laid out for two Hundred and forty One Acres More or Less To Have and to Hold the aforesaid Parcell of Land together with all Houses fences Buildings and all other their Rights Members and Appurtenances unto the said Mordecai Gist his Heirs and Assigns and to the use and Behoof of the said Mordecai Gist his Heirs and Assigns forever and also all the Right Title Property Interest Claim and demand of him the said Thomas Gist in and to the same and the said Thomas Gist for himself and his Heirs doth Covenant and agree to and with the said Mordecai Gist his Heirs and Assigns that he the said Thomas Gist at the time of Ensealing hereof is and stands Possessed of a good sure and Indefeasible right of Inheritance in Fee Simple to the said Parcell of Land and Premisses with all its Rights Priveleges Members and Appurtenances and that the said Mordecai Gist and his heirs shall and may from henceforth forever hold have Occupy and Possess and Enjoy the aforesaid Parcell of Land and Premisses together (with) |
