725 that the Councell for the right hon.ble the right hon.b the Lord proprietary deureing time to be heard heard herein & that the passing of the said Act might be suspended till such time as they could write to his Lordship above this Case they p.rsuming this to be Escheat & as being purchasd by Cordea before his Naturalization or upon some other account for want of heires of Walter Hall decd in whom as was p.rtended the inheritance then remaind by the purchase from Nuthall as afd It was thereupon ordered that the further Debate upon the said Bill should be respited to the next sessions of Assembly Afterwards to witt about Michaelmas 1695 the Cred.rs pressing for their Debts pticularly the Children of Anthony Lecoutst decd whose Relict & Exe.rx the said Cordea had Marryed some of them being unpayd their porcons for the paym.t whereof the said Garrett Vansweringen & James pattison of S.t Marys County as having Married the Relict & Ex.rx of the said Walter Hall who was also bound with & as security for the said Cordea to pay the said Childrens porcons to the Lord prop.ry in one hundred & fifty Thousand pounds of Tobo.o & threatning Suite & have since obtaind Judgm.t ag.t the said pattison & Vanswerengen on that Bond they requested Rob.t Carvile who had before sollicited for the passing the said Bill to take the said papers & writings relating to the said Cordeas Land so given & devised as afd & to further & promote the passing the same & that this house on the return of the London Fleet by which time it was presumed they might hear from his Ldsp out of England And the said Robert Carvile having recd from the said pattison & Vansweringen certain writings bound up together in which were containd the Originall & Originall Writing & Division made between the said Walter Hall & Marke Cordea as afd & two Deeds of sale & bonds for performance of Conditions in the said Deeds containd from one John Barnes of the same County for the Conveyance of two certain Tracts of Land part of the said Mann.rs bought by the said Cordea of the said Barnes for 33000£ of Tob.o truly paid by Cordea to Barnes & some other writings & Conveyances with intent to bring to Annapolis & produce the same in order to the passing the Act the said Carvile by an unhappy accident lost his bagg of writings in which were the Writings afd as by the severall Affidavits hereto annexd may more plainly appear so that the same Writings not being recorded in the prov.ll or County Court the Cred.rs ^of^ will be at a great loss about their D.ts if not relieved herein by Act of Assembly to give title to trustees to be appointed to sell the said Lands for paym.t of the Debts afd for which they are become further (suitors |
