98 To the Honob.le Thomas Notley Esq.r Leiu.t Gene.ll and Cheife Governo.r of Maryland and the Rest of his Associates Justices of the Provinciall Court These are humbly to Certifye your Hono.rs that by virtue of A Comission Issued out of the said Court beareing date the Seaventeenth day of October 1678 Directed to us Thomas Truman Esq.r Richard Ladd and Charles Boteler Gentlemen to hear and determine all matters and differences in Question betweene Job Nutt Plaintiffe and Henry Jowles and Sybell his wife Execut.r of William Groome deceased Defendents in one Accon of Law depending betweene the Said partys and alsoe in one Suite in Chancery betweene the Said Henry Jowles and Sybell his wife Execu.rx of the Said William Groome pl.ts and Job Nutt and Micheall Tawney Def.ts by virtue of which Comission wee or any two of us Should meete at Such tymes or tymes and place or places as to us or any two of us Should seeme fitt to heare all Such Megacons Arguments debates proofes Evidences and wittnesses as by the Severall partyes aforesaid or their Respective Attorneyes Should be produced before us whereby the truth of the matter in Controversie between the partyes aforesaid Should be made more manyfest unto us we have in the p.rsence of Christopher Rousby Gentleman and Michaell Tawney Attorneys of Job Nutt and Henry Jacobs and Sybell his wife Executrix of William Groome as aforesaid and Robert Carvile Gentleman their attorney Considered the true merritts of the matter in difference betweene the partyes aforesaid and have heard and Read the profes Allegations accompts discounts Charge and discharges which were produced before us And upon the which matter and Serious advise and Deliberate Consideracon of the p.rmises we doe order Judge and determine as followeth (viz.t) First that the Said Henry Jowles and Sybell his wife Executrix of William Groome afors Deceased do well and truley Deliver unto the aforesaid Job Nutt his Attorney or Attornys Assinee or Assignes and upon the plantacon of the said Job Nutt in pautuxent River Eighteene Cowes Fiffteene Calves One Bull of four yeares old four Cattle of two yeares old each Five Steeres of three yeares old each two sows two Barrows one Boar homle poultry and severall houshould goods mentioned in a Scedule hereunto annexed att or before the tenth day of January next Ensueing the date of these presents And wee doe further order Judge and determine that the aforesaid Michaell Tawney Attorney of the aforesaid Job Nutt Shall upon due notice given by the aforesaid Henry Jowles or his order be ready at the aforesaid plantacon of the Said Job Nutt to take and Receive All and every the aforesaid Cattle hoggs poultry and houshold goods Soe to be delivered by the Said Henry Jowles and Sybell his wife as aforesaid and to give Receipt unto the Said Henry Jowles & Sybell his wife for the Same Secondly we doe order Judge and determine that the aforesaid Henry Jowles and Sybell his wife Executrix of William Groome as aforesaid doe well and truely pay unto the Said Job Nutt his Attorney or Attorneys Assignee or Assignes the full and Just Sume of Eleaven thousand two hundred and Five pounds of Tobacco Conveniently in Calvert County att or upon the tenth day of January which Shall be in the yeare of our Lord One thousand Six hundred Seaventy nine Thirdly wee doe order Judge and determine that the aforesaid Henry Jowles and Sybell his wife Executrix of William Groome as aforesaid doe make Seale and deliver unto the Said Job Nutt his Attorney and Attorneyes Assignee and assignes one good and Sufficient Release and discharge of and from all Bargaines Covenants Contracts agreements Bills Bonds writeings and Accompts whatsoever And also from all and all maner of Errors or Errors whatsoever in the Suites above Specifyed And alsoe that the Said Michaell Tawney Attorney of the Said Job Nutt or other the Attorney or Attorneys of the Said Job Nutt for the tyme being doe upon the pformance of all and Singular of the orders Judgements and determinations aforesaid make seale and deliver unto the said Henry Jowles & Sybell his wife Executrix of William Groome as aforesaid One good and sufficent |
