97 Charles Absolute Lord and proprietary of the Provinces of Maryland and Avalon Lord Baron of Baltemore &.ca To Thomas Truman Esq Richard Ladd Gentleman & Charles Boteler Gentl Greetings whereas Henry Jowles Late of Calvert County Gentl and Sybell his wife Executrix of the Last will and Testament of William Groome of Calvert County deceased were bt writt out of our provincial Court Sumoned to Answer unto Job Nutt of a plea that they render unto him Six hundred pounds Sterling which from him they unjustly deteyne and whereas the said Henry and Sybell have Exhibbited their Bill of Complaint in our high Court of Chancery to be Releived against the aforesaid Accon of the said Job Nutt And forasmuch as the Attorneys on the Behalfe of the partyes aforesaid to Christopher Rousby Gentleman Attorney for the said Job Nutt And Robert Carvile Gentleman Attorney of the said Henry Jowles and Sybell his wife for preventing the Tedious depending of the suite aforesaid and for saveing the Extraordinary greate Charge which the Attendance and prosecution of y.e premisses in our Courts aforesaid must necessaryly occasion and the Rather because of the greate remotenesse of the said Job Nutt being an Inhabitant within the Kindome of England and aged and incapable of undertakeinge soe Long a voyage as to Come to this province to Answer the said Bill Have therefore made it their Joynt Speciall & earnest Request to us to Nominate Authorize and appoint in Difference as aforesaid betweene the partyes aforesaid And the said Attorneys haveing in open Court before us on behalfe of their Said Respective Clyents mutually agreed to stand to abide & and be Concluded by the Judgem.t and determinacon in the matters aforesaid of such persons Soe to be nominated and Authorized and appoynted by us as aforesaid Now wee being willing to Comply with the said Earnest mutuall and reasonable request of the said Attorneyes on Both sides and much Confideing as well in the Knowledge Skill and Ability as in the Fidellity honesty and Impartiallity of you the Said Thomas Truman Richard Ladd and Charles Boteler have therefore thought fitt and doe hereby nominate Authorize and Appointe You the said Thomas Truman Richard Ladd and Charles Boteler or any two of you to meete at such Tyme or Times and place or places as to you or any two of you Shall Seem Fitt To hear all such Alegacons Arguments Debates Proofes Evidences & wittnesses As by the Severall partyes aforesaid or their Respective Attorneyes Shall be produced Before you whereby the truth of the said Matters in Controversie Between the partyes aforesaid may be made more manyfest unto you and wee ^doe^ hereby will and Require that the Said partyes or their Attornys doe from tyme to tyme Observe and attend you att such place or places as you or any two of you shall appoynte to hear the matters aforesd untill the same Shall by you or any two of you be whilely Determined And wee further will and Comand that what you or any two of you shall upon Consideracon of the whole matters So to be heard by you or any two of you as aforesaid Consider and adjudge in Reason Justice and Equity to be done or paid by Either party plaintiffe or defendent according to the true merritt of the Cause that the Same fairly written and by you or any two of you Signed and Sealed you Justices of our Provinciall Court att our Court to be held the Fifth day of march next to the Intent the Same may be Rattifyed and Confermed by our said Court according to the Speciall Instance and request made by the Attorneys on both Sides as aforesaid And wee doe further Authorize you to administer Oath or oathes to any Wittnesse or wittnesses that shall be produced to you in Relacon to the premisses for all which Actings and doings before menconed this Shall be your Sufficient Warrant wittness our trusty and wellbeloved Thomas Notley Esq our Leiu.t Generall and Chiefe Governour of our said province of Maryland the Seaventeenth day of October in the third yeare of our dominion &.ca Anoq Dom One thousand Six hundred Seaventy Eight One the backside of the foregoing Comission was written as foll (viz.t) The Execuon of this Comission appeared by Severall Scedules hereunto annexed Tho Truman Sealed Rich Ladd Sealed C Boteler Sealed |
