325) 334 call and Comand before you all Comanders Masters of shipps or Vessells and all and every other persons whatsoever who aswell on the behalfe of our Soveraigne Lord the King and the behalfe of the Right hon.ble the Lord Prop.ry as on the part of him or themselves prosecute And to veiwe peruse and looke into all papers passes passports Cocquetts and bills of loading letters Credentiall and other escripts whatsoever That shall any ways relate to or concerne the said shipp And issue out Veniries and sumons Juries for the purpose aforesaid and sweare the same Juro.rs And haveing fully heard the proofes Allegacons evidences and Testimonys on boath sides And the Verdicts of the Juro.rs (if any be) Then to give yo.r full and finall doome sentence and determinacon either for the acquittall or Condemnacon of such ship or ships Vessell or Vessells Together w.th their guns tackle amunicon and furniture as alsoe all goods Merchandizes & Comoditys seized or informed against And when it shall soe happen That the Informacon is confirmed and such Vessell or goods confirmed for breach of the Acts of Parliam.t in that case made Then that you appoynt two or more honest and discreete men such as to you shall seeme meete to appoynte the same together with their guns amunicon apparrell and goods w.ch wee doe hereby Impower you or any of you to Administer unto them and further to nominate and make Knoyne of such person as you or any of you shall thinke fitt to be Clerke of the said Cort for the more full doeing manageing and transacting the p.rmisses Hereby comanding you to send unto o.r beloved Henry Darnall and William Diggs Esq.rs or either of them with the said Appraisem.t under the hands and Seales of the said Appraiso.rs attested under the hand of the said Clerke And for yo.r proceedings herein this shalbe yo.r warrant This Comission and the power therein granted to stand force for Two months after the date hereof or untill the same be revoaked by us or some others for that purpose by Impowred Witness our well beloved Henry Darnall & William Diggs Esq.rs Att our Citty of S.t Marys the Eighteenth day of March in the Tenth yeare of our Dominion &c.a Annoq.r Dm 1685 Which said Comission being made Nicholas Sewall Esq.r his Majestys Collecto.r in this Province by Robert Carvile his Attorny p.rsents an Informacon to this Court which follows in these words viz.t Maryland fs Bee it remembred that on the second day of Aprill in the yeare of our Lord 1685 Came here into Court the hon.ble Nicholas Sewall his Majestys Collector of all the rates duetys and Imposicons due & payable to his said Majesty in Maryland in his proper person who aswell for our soveraigne Lord Charles the Second by the grace of God of England Scotland France and Ireland King Defender of the Faith &c And the Right hon.ble the Lord Prop.ry Cheife Governo.r of this Province of Maryland and for himselfe in this behalfe prosecuteth and aswell for the said Lord the King and the said Governo.r as for himself exhibited to the Court here his Certaine bill of Informacon against John Estis Comander of the Shipp Providence of Deale and Jasper Lynch late of Galloway in the Kingdome of Ireland Merchant Freighto.r of the said Shipp Thereby giveing the Court here to understand and be informed that whereas in the state made in the Parliam.t of our said Soveraigne Lord the King of England &c in the fifteenth yeare of his raigne at Westminster in the County of Middlesex in the Kingdome of England (amongst other things it was enacted by authority of the same Parliament The (from |
