240 250 This Indenture Witnesseth that Patrick Gormack aged about twenty Seaven yeares from the Kingdome of Scotland Accompt and Not contracted to any psons Service but Free and at his owne dispose and voluntary Consent doe put himself a Covenant Servant and doe Covenant by these presents to and with Stephen Mitchell Marriner to faithfully Serve him his Executo.rs or Assignes from the day of the date hereof untill his first and next Arrivall in the land of Virginia and after for and during the terme of foure yeares in such trade or Calling he is or fit for any such imployment as he the said Stephen Mitchell his Executo.rs or Assignes shall imploy this according to the Custome of the Country In Consideration whereof the sd Stephen Mitchell for himself his Executo.rs and Assignes doth Covenant promise grant and agree to & with the said Patrick Gormack to pay for his passage in the good shipp the Experiment Cap.t James Conger Comand.r or in any other shipp thither directly bound by the Order and directions of the said Stephen Mitchell his Ex.rs or Assignes and also to find and provide him meat drinke apparrell washing and Lodgeing dureing the said terme And in the end of the said Terme the sd Covenant Servant shall have all Such Allowance of apparrell pvisions & other necessaryes as to others are allowed given and granted according to the Custome of the Country Att present delivered and payd to the use wch he Received on board Cloathes and one shilling money as earnest for that he shall proceed & serve according to the true meaning of this his Indenture and the Act of Parliament made and Provided in that behalfe And in Case the Said Patrick Gormack shall not Proceed the said voyage by any dislike hee Covenants Promises and warrants to repay back againe to the said Stephen Mitchell or his order all such Moneys layd out for him for Cloathes and for all Other charges without fraud or deceipt And for the true performance of all and Every the Covenants and agreements herein contained Either part to the other bindeth himself by these p.rsents In witnesse whereof the partyes Above mentioned to these p.rsent Indentures have Interchangeably sett their hands and Seales the seaven & twentyeth Day of October 1682 Sealed and delivered in Stephen Mitchell Sealed the presence of Ed Lorvis W.m Taylor On the back side of the above Indenture was written thus January the 10.th 1682 I doe Consigne over all my right and Title of this within mentioned Indenture unto John Baker he his heires & Assignes as witnesse my hand James Congdon And likewise thus Entered with the Capes of Virginia the 21.th day of May in the yeare 1682 This Indenture made the Twentyeth day of November in the yeare of our Lord God One thousand six hundred Eighty Two Betweene Daniel Pensax of London Marriner on the One part and Edmund Howard of Somersett County Gent of the other part Witnesseth that the said Daniel Pensax as well for and in Consideracon of the full quantity of Fourteene thousand pounds of Tobacco to him in hand payd by the said Edmund Howard before the ensealing and deliver of these p.rsents the receipt whereof he doth hereby acknowledge and thereof and of every (part |
