(159) 168 of Chesepeake Bay Containing Five thousand seaven hundred Acres more or Lesse And the said William Hawley being thereof soe seized did afterwards by his Last will and Testament in writeing under the hand and seale Give Bequeath and devise the same unto the said William Guither his heires and assignes for Ever By vertue of w.ch said will and by a Decree in Chancery lately Obtained hee the said William Guither to become Lawfully seized and posessed of the same Now This Indenture further Witnesseth that hee the said William Guither for and in Consideracon of the sume of Ten thousand pounds of Tobacco To him in hand paid by the said John Baker before the Ensealeing and delivery of these p.rsents the Receipt whereof hee doth hereby acknowledge and thereof and of every part and Parcell thereof doth Clearely and Absolutely Acquitt and Discharge the said John Baker his heires Executo.rs and Adm.rs by these p.rsents and For the Rents and services hereafter due and Reserved And for divers other good Causes and Consideracons him thereunto moveing have Bargained sold Alienated enfeoffed and Confirmed and Doe by these p.rsents bargaine sell Aliene Enfeoffe and Confirme unto the said John Baker his heires Executors and Adm.rs All that Tract parcell or Divident of Land Called Courseys Neck scituate Lyeing and being in the County aforesaid Bounding west on the east side of St Jeromes Creeke East w.th a marked oake by the bay side on Tohee Warners Land north and south on the said bay and St Jeromes Creeke Containing by estimacon Five hundred Acres more or lesse w.th all and every the Lands Tenements houses buildings Orchards pastures Rights Members & appurtenances to the said parcell of Land belonging or appertaining To have and To hold the same unto him the said John Baker his heires and Assignes for ever Yeilding and paying therefore yearely and Every yeare unto the said William Guither his heires Executors and Adm.rs att the now Dwelling house on the Plantacon on w.ch the said William Guither now Lives on the feast of St Thomas the Apostle in Every yeare the Rent of seaven bushells of sound Indiane field Corne and if itt shall happen the said yearely Rent of seaven bushells of Indian Corne or any parcell thereof to bee behinde & unpaid in part or in all after the said Feast of St Thomas The Apostle in which the same ought to bee paid by the space of forty daies that then and from thence forth Itt shall and may be Lawfull for the said William Guither his heires Executo.rs or Adm.rs unto the said Land and p.rmisses to Reenter reposse and reenjoy as in his and theire former Estate Anything herein Contained to the Contrary thereof notwithstanding And the said William Guither doth hereby for himself his heires Executo.rs and Adm.rs Covenant and agree to and with the said John Baker his heires Executors and Adm.rs by these p.rsents that hee the said William Guither att the Ensealeing and delivery of these p.rsents is and doth stand seized of a Firme good sure and indefeazable estate of Inheritance in fee simple of and in the Land and premisses hereby bargained and sold And that hee hath full Right power and Lawfull authority to bargaine sell the same Land and p.rmisses unto the said John Baker and his heires and that hee will for Ever warrant and defend the same to him the said John Baker his heires and that hee will for Ever against all persons whatsoever Claymeing by from or und.r him the said William Guither or his heires Executo.rs adm.rs or assignes the Rents and services due and to bee due and payable to the Cheife Lord of the Fee of the p.rmisses to bee paid by the said William Guither his heires Executors or Adm.rs for ever In witnesse whereof the parties Above named have to these present Indentures Interchangeably sett theire hands and seales the day and yeare first above written Signed sealed and delivered in the presence of Nic Painter William Guither (sealed) |
