133) 142 unto John Shankes in a plea that hee Render unto him the sume of Eight hundred twenty Eight pounds of Tobacco w.ch him hee oweth and unjustly deteyneth Hereof faile not att your perill and have you there this writt Given under the seale of our said County the seaventh day of June in the third yeare of our Dominion &c Annoq Dom One thousand six hundred seaventy Eight Vera Copia p John Marley Clke Att a Court held att Newtowne for The R.t Hono.ble the Lord Prop.ry & for the County of Saint Maryes on the first Tuesday in September Annoq Dom One thousand six hundred seaventy eight Cap.t John Coode M.r Clem.t Hill Present M.r W.m Hatton M.r Joseph Pile Comission.rs M.r Richard Lloyd John Shankes plant Richard Walker Deft St Maryes County fs Richard Walker was Attached to Answere unto John Shankes in a plea that hee render unto him the summe of Eight hundred twenty Eight pounds of wch Richard Hart late of this County to him well and unjustly deteyneth for that the said Walker did transport the said Hart out of this province Contrary to an Act of Assembly in that Case made and Provided Anno One thousand six hundred seaventy foure Whereupon the said John Shankes by Thomas Lomax his Attorney sayth that Whereas the said Richard the five and twentieth day of October Anno One thousand six hundred seaventy seaven did by his Certaine writeing Obligatory sealed w.th the seale of the said Richard and here in Court produced whose date is the day and yeare above written acknowledge himselfe to owe and stand indebted to John Shankes Eight hundred twenty eight pounds of Good Sound Marchantable Arrenoca Tobacco and Caske Which I binde me my heires Executors Administrators or assignes to pay to the said John Shankes his heirs Executors adm.rs or assignes to a Tobacco to bee paid upon all demand next Ensueing the date hereof Notwithstanding wch the said Richard the said sume of Eight hundred twenty Eight pounds of Tobacco according to the teno.r of his said obligacon hath not paid though often thereunto required but since some time in the moneth of February or March Anno One thousand six hundred seaventy seaven the said Richard Walker did by Lending the said Richard Hart his Boate Transport the said Hart out of this province to the deceiving and defrauding his Creditors or theire Just debts Contrary to an Act of Assembly to the Losse and dammage of the said John Thirteen hundred pounds of Tobacco And thereupon hee brings his suite Pleg de pr John Doe Tho Lomax p quer Rich Roe And the said Richard Walker by Abraham Coombe his Attorney Cometh and defendeth the force and Injury when &c and saith hee is not Thse guilty of the breach of the Act of Assembly in the declaracon aforesaid menconed and of this hee putts himselfe upon the Country Abraham Combe p q.r Deft And the p.lt by Thomas Lomax his Attorney sayth that hee the said Walker did both Wittingly and willingly Lend the said Hart his boate to transport him out of this Province as in the declaracon exprest and for Tryall putts himselfe upon the Country Thomas Lomax p p.lt Know all men by these p.rsents that I Richard Hart of Saint Maries County plant.r doe owe and stand indebted unto M.r John Shankes of the abovesaid County Eight hundred twenty eight pounds of good sound Marchantable Arrenoco Tobacco in Caske wch I binde me my heires Executors Adm.rs or assignes this to bee paid upon all demands ensueing (the |
