Article — Real Property

Section 11-102.1

Annotated Code of Maryland

As enacted by Chapter 12 (SB 200) of the 1974

Regular Session of the General Assembly

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND. That new Section 11-102.1 be and it is hereby
added to Article — Real Property, of the Annotated Code
of Maryland. (As enacted by Chapter 12 (SB 200) of the
1974 Regular Session of the General Assembly) to read as
follows:

11-102.1

[[WHEN A PROPERTY IS CONVERTED TO A CONDOMINIUM, THE
OWNER OF THE PROPERTY SHALL GIVE ALL TENANTS 120 DAYS
NOTICE OF THE PROPOSED CHANGE. THE TENANT MAY ELECT TO
REMAIN A TENANT OR LEAVE THE PROPERTY WITH NO PENALTIES
ENFORCEABLE BY THE PROPERTY OWNER AGAINST HIM.]]

(A) RESIDENTIAL REAL PROPERTY MAY NOT BE CONVERTED
TO A CONDOMINIUM UNLESS THE OWNER OF THE RESIDENTIAL REAL
PROPERTY HAS GIVEN 120 DAYS PRIOR WRITTEN NOTICE OF THE
CONVERSION TO BACH OF THE TENANTS OF THE BUILDING OR
BUILDINGS SCHEDULED FOR CONVERSION.

(B) A TENANT MAY NOT BE REQUIRED TO VACATE THE
PROPERTY DURING THE PERIOD OF THE NOTICE REQUIRED UNDER
SUBSECTION (A) EXCEPT FOR:

(1) VIOLATION OF A COVENANT IN THE LEASE, OR
(2) NON-PAYMENT OF RENT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1974.
