ARTICLE V. PARKING COMMERCIAL VEHICLES AND
REPAIR OF VEHICLES ON STREETS.
108-37. Definitions.
For the purposes of this Article, the following words and
phrases shall have the meanings respectively ascribed to them by this
Section:
Bus. Any motor vehicle designed or used for carrying more than
ten passengers, except vehicles clearly marked and used for school
pupil transportation.
Commercial Vehicle. Any motor vehicle, including semi-trailers
and trailers, designed or used for carrying freight or merchandise or
used in any business or trade. Such term does not include a motor
vehicle owned by the County or other governmental agency and used
primarily for carrying passengers, nor does it include trucks of less
than one ton capacity.
Park. Leave a vehicle standing on a public highway, whether
or not attended, except when standing in obedience to traffic regula-
tions, a police officer or traffic signs and signals.
108-38. Applicability of Article.
The provisions of this Article shall be effective throughout the
County, except in any incorporated city, town or special taxing area
specified in Article I, Section 101, of the Montgomery County Charter,
to the extent that such city, town or special taxing area has authority
to adopt regulations equivalent to those herein contained. If the
governing body of such incorporated city, town or special taxing area
lawfully adopts this Article and requests the County to provide for
the administration and enforcement thereof within such town or
special taxing area, then the County may administer and enforce
this Article within such town or special taxing area.
108-39. Parking of commercial vehicles or buses abutting residences,
schools, etc.
It shall be unlawful to park any commercial vehicle or bus on
that side of any public road abutting any private residence, apart-
ment house, church, school, hospital or playground except when such
vehicle is actually engaged in loading or unloading passengers, mer-
chandise or materials, or when used by the owner or operator actively
engaged in work on the premises of the residence, apartment house,
church, school, hospital or playground. At authorized terminal stands
of bus routes operating under a permit from the State Public Service
Commission, stops may be made for a sufficient period of time, not to
exceed thirty minutes, for the purpose of maintaining schedules.
This Section shall not apply to a vehicle involuntarily parked because
of mechanical failure or other emergency, provided such vehicle is
removed within a reasonable period of time.
